Barnets bästa ska vara avgörande vid alla beslut som rör vårdnad, boende och umgänge. Vid bedömningen av barnets bästa skall hänsyn tas till barnets vilja med beaktande av barnets ålder och mognad. Det framgår tydligt av såväl FN:s konvention om barnets rättigheter (barnkonventionen) och av svensk lag. Lagtexten ger endast vägledande riktlinjer när det gäller bedömningen av barnets bästa för att utredare, såväl socialnämnd som domstol, ska kunna vara fria att göra en individuell bedömning av det aktuella barnet. Att hänsyn ska tas till barnets vilja är däremot en klar regel som i förarbeten har ett begränsat utrymme för undantag. Att barnets vilja ska få komma till uttryck är en grundläggande rättighet som också utgör en av grundpelarna i barnkonventionen. Eftersom att bedömningen för barnets bästa, där barnets rätt att bli hörd ska ingå, är så generell är det enligt förarbeten extra viktigt med transparens i utredningar och domar. Trots föregående framgår det i begränsad utsträckning, av de i uppsatsen undersökta domarna angående vårdnad, hur bedömningen av barnets bästa har gått till och vad barnet har gett uttryck för. Det kan antingen ha att göra med en brist i transparensen eller att domstolen helt enkelt inte gett utrymme till barnets vilja i bedömningen. (Less)

The best interest of the child should always be decisive in all decisions concerning custody, accommodation, and relations of the child. When assessing what is best for the child the will of the child should be considered. Moreover, the will of the child should be evaluated according to two affecting factors; age and maturity. This clearly appears in the Convention on the Rights of the Child presented by the United Nations, and is also strengthened by Swedish law. To assure that investigators, both the social welfare board and the court, have the best possible opportunities of taking right decisions and actions for each individual case, legislative texts only present directive guidelines. The best interest of the child should always be decisive in all decisions concerning custody, accommodation, and relations of the child. When assessing what is best for the child the will of the child should be considered. Moreover, the will of the child should be evaluated according to two affecting factors; age and maturity. This clearly appears in the Convention on the Rights of the Child presented by the United Nations, and is also strengthened by Swedish law. To assure that investigators, both the social welfare board and the court, have the best possible opportunities of taking right decisions and actions for each individual case, legislative texts only present directive guidelines. However, to consider the will of the child there is a clear rule, which in preliminary work has no or very limited space for exceptions. The child should always have right to express his/her will, and if the will shall be considered of dignity in the investigation, that decision needs to be based upon the degree of maturity of the actual child together with his/her ability of understanding consequences. The opportunity for the child to express his/her will is a fundamental right that also constitutes one of the foundation pillars in the Convention on the Rights of the Child. Because the judgement process is general in its nature, it is extraordinarily important that investiga-tions and judgements are transparent to ensure that the will of the child is expressed and considered. Despite what previously been mentioned, it should be emphasized that it is only to a limited extent revealed by the studied custody judges in question how the assessment of the best interests of the child has taken place in terms of what that has been expressed by the children and considered as decisive in the specific cases. This can either be related to lack of transparency or that the court did not give any room for the child’s will in the assessment. (Less)
