Abstract
In Sweden there are still problems with honor-related violent crime. In 2016, one third of all murders committed against women were honor-related murders. Many voices have been raised in order for a punishment to take place in the area.
The purpose of the present paper has been to investigate whether there is a need to introduce a special regime for violent crime with honor as a motive for punitive purposes. In addition, the following question is whether there is a need or not, and if so how can this be solved.

In Sweden there are still problems with honor-related violent crime. In 2016, one third of all murders committed against women were honor-related murders. Many voices have been raised in order for a punishment to take place in the area.
The purpose of the present paper has been to investigate whether there is a need to introduce a special regime for violent crime with honor as a motive for punitive purposes. In addition, the following question is whether there is a need or not, and if so how can this be solved.
Specifically, I have planned to clarify how the court deals with honorary issues in practice. The discourse is meant to analyze the cases of subordinates and is structured according to which, in this case, disputes concerning honor and punishment assessment are concerned. I think it has been important to convey the true picture and avoid self-reformulation of the court's reasoning as the real meaning is likely to lose its meaning. Hence, in this discourse analysis, the application of narrative reading has also been made to show the real image. Applicable right and these subcommittee judgments serve as the basis for the question of the need. It is only when a deficiency has been identified as a matter of specific regulation has been discussed. For the present investigation, I have applied a legal-judicial method where my starting point has been in existing legislation, case law and draft legislation.
Regarding the approaches, in order to accommodate a possible need, I have conducted an internal comparative law comparison between domestic violence against women and honor-related violent crime. The conclusion I have come to is that there may be a need to legislate honor-related violent crime. One reason is to create more predictability for the courts in how to consider honor in violent crime. Secondly, to mark from the State that honor-related violent crime is socially unacceptable.
The conclusion I have reached, taking into account the current criminalization principles, current laws, and draft legislation, is that a special legislation in this area may not be acceptable, as the type of crimes that I intend to cover are already covered by existing legislation. However, even though I interpret 29 chap. 2 § of the Swedish Code of violations as already applicable, that a marker from the State would act in a positive direction both in terms of taking a stand against honorary oppression and for creating better predictability for law practitioners. I Sverige förekommer fortfarande problem med hedersrelaterade våldsbrott. År 2016 var en tredjedel av alla mord som begicks mot kvinnor hedersrelaterade. Många röster har höjts för att en straffskärpning bör ske på området.
Mitt syfte med uppsatsen har varit att utreda om det finns ett behov att införa en särreglering vad gäller våldsbrott med heder som motiv i straffskärpande syfte. Följande frågeställning är huruvida det finns ett behov eller inte, på vilket sätt kan i så fall detta lösas genom.

Konkret har jag ämnat klargöra hur rättstillämningen behandlar hedersproblematiken i praktiken. Diskursen har inneburit att analysera rättsfallen från underinstanserna och strukturera efter vilka i detta fall gäller diskurser om heder och straffvärdebedömning. Jag anser att det har varit viktigt att förmedla den verkliga bilden och undvika egna omformuleringar av domstolarnas resonemang då den verkliga innebörden riskerar att förlora sin innebörd. Därav har i diskursanalys även tillämpning av narratologisk avläsning gjorts för att visa den verkliga bilden. Gällande rätt och dessa underinstansdomar tjänar till att vara underlag för frågan om behovet föreligger. Det är först när en brist har kunnat fastställas som en fråga om särreglering har kunnat diskuteras. För utredningen har jag tillämpat rättsdogmatisk metod då jag har utgått från gällande lagstiftning, rättspraxis, förarbeten. Avseende tillvägagångssätten för att kunna tillmötesgå ett eventuellt behov har jag gjort en internkomparativrättslig jämförelse mellan grov kvinnofridskränkningsbrottet och hedersrelaterade våldsbrott.
Resultatet jag har kommit fram till är att det visst kan föreligga ett behov av att särreglera hedersrelaterade våldsbrott. En anledning är för att skapa mer förutsebarhet för domstolarna i hur heder bör beaktas i våldsbrottssammanhang. För det andra att markera från statens sida att hedersrelaterade våldsbrott är socialt oacceptabla.
Slutsatsen jag har kommit fram till, med beaktande av rådande kriminaliseringsprinciper och nuvarande lag och förarbeten, är att en särreglering på området inte torde vara godtagbar då de brottstyper som jag avser att omfatta redan täcks av befintlig lagstiftning. Däremot anser jag, trots att jag tolkar 29 kap. 2 § BrB som redan tillämplig, att en markering från staten sida skulle verka i positiv riktning både vad gäller att ta ställning mot hedersförtryck samt för att skapa bättre förutsebarhet för rättstillämparna.
