One-Size-Traps-All? A Sub-national Study on the Impact of the TRIPs Agreement on India's Innovative Activity

Abstract
In an integrated world economy, innovation is considered one of the main catalysts for economic development and growth. To stimulate the very and enable technological change, innovators need to be granted the rights to their own creations. The Word Trade Organization therefore implemented the Agreement on Trade Related Aspects of Intellectual Property Rights in 1995 among all its member states, with the purpose to provide a one-size-fits-all minimum standard of intellectual property rights protection. In an integrated world economy, innovation is considered one of the main catalysts for economic development and growth. To stimulate the very and enable technological change, innovators need to be granted the rights to their own creations. The Word Trade Organization therefore implemented the Agreement on Trade Related Aspects of Intellectual Property Rights in 1995 among all its member states, with the purpose to provide a one-size-fits-all minimum standard of intellectual property rights protection. As per contra, developing countries formerly applied development strategies of import substitution and imitation, India was in particular opposed to stricter protection mechanisms. To analyze the impact of TRIPs on India’s innovative activity output, this study uses a panel data fixed effects analysis of six Indian states. The results show that TRIPs had a significant positive impact on the innovative activity in the overall sample. However, when including state and TRIPs interaction variables, the outcome of the model implies that TRIPs is only positive significant in states with already high levels of development. States with fewer patent applications are, in contrast, significantly dependent on expenditures of the public social sector to spur innovation and economic development. The government thus needs to invest public expenditure to kick off innovative activity on a sub-national level. (Less)
