- Syftet med denna uppsats är att undersöka kärnvapens laglighet under IHL, med särskilt fokus på fem för rättsområdet grundläggande principer. Världens stater har förklarat sig vara bundna av IHL:s generella principer och kärnvapenstaternas praxis har bekräftat att principerna har relevans för kärnvapenanvändning under väpnad konflikt. Det är emellertid omstritt exakt vilka och hur långtgående begränsningar de generella principerna föreskriver i relation till kärnvapen.
Efter en inledande presentation av distinktions-, försiktighets- och proportionalitetsprincipen samt förbuden mot användande av urskillningslösa vapen och vapen som orsakar överflödig skada eller onödigt lidande, ska principernas räckvidd i förhållande till kärnvapen... Det är emellertid omstritt exakt vilka och hur långtgående begränsningar de generella principerna föreskriver i relation till kärnvapen.
Efter en inledande presentation av distinktions-, försiktighets- och proportionalitetsprincipen samt förbuden mot användande av urskillningslösa vapen och vapen som orsakar överflödig skada eller onödigt lidande, ska principernas räckvidd i förhållande till kärnvapen studeras. För att besvara frågeställningen huruvida all kärnvapenanvändning är förbjuden enligt den internationella humanitära rättens grundläggande principer ska doktrin och juridisk argumentation, för och emot kärnvapens laglighet under IHL, analyseras.
Uppsatsen visar att oenigheten i internationell juridisk debatt främst handlar om huruvida de s.k. taktiska kärnvapnen med kort räckvidd är möjliga att använda i obefolkade områden i förenlighet med IHL:s principer. Mot bakgrund av vad som är känt om också dessa kärnvapens oerhörda konsekvenser, särskilt vad gäller radioaktiviteten som vapnet frigör, kommer uppsatsen fram till att det finns ett absolut förbud mot kärnvapenanvändning under väpnad konflikt. Uppsatsförfattaren menar att en olaglighet i alla omständigheter kan härledas från försiktighetsprincipen och förbudet mot vapen som orsakar överflödigt lidande eller onödig skada.
Mot bakgrund av den risk för upptrappning som följer kärnvapenanvändning och de politiska hinder som i dagsläget försvårar kärnvapennedrustning är slutsatsen om rättsläget på IHL:s område tillfredställande, utifrån ett kritiskt perspektiv. (Less) - Abstract
- The purpose of this essay is to examine the legality of nuclear weapons
under international humanitarian law1, focusing on five selected principles of fundamental importance for the entire body of IHL.
It is widely accepted that the general principles of IHL subject the
deployment of force during armed conflict to restrictions. The states of the international community have willingly articulated their commitment to the general principles of IHL, and state practice has confirmed that they are relevant to the use of nuclear weapons. At the same time states anxiously guard their right to determine the exact provisions of the limitations and how far they reach in relation to nuclear weapons.

under international humanitarian law1, focusing on five selected principles of fundamental importance for the entire body of IHL.
It is widely accepted that the general principles of IHL subject the
deployment of force during armed conflict to restrictions. The states of the international community have willingly articulated their commitment to the general principles of IHL, and state practice has confirmed that they are relevant to the use of nuclear weapons. At the same time states anxiously guard their right to determine the exact provisions of the limitations and how far they reach in relation to nuclear weapons.
After an introductory presentation of the principles of distinction and
proportionality, the rule of precaution in attack and the prohibitions on the use of indiscriminate weapons and weapons of nature to cause superfluous injury or unnecessary suffering, the principles will be applied to the use of nuclear weapons. To answer the research question, whether the use of nuclear weapons is prohibited under all circumstances according to IHL, international legal doctrine and legal argumentation, pro and contra the legality of nuclear weapons, will be analyzed.
The essay will show that the disagreement in international legal debate
mainly concerns the so-called tactical low yield nuclear weapons and their use outside populated areas. Considering what is today known about the destructive effects of nuclear weapons, particularly concerning the
radioactivity the weapon releases, the essay concludes that there is an
absolute prohibiton against the use of nuclear weapons during armed
conflict. According to the author this can be derived from the principle of precaution and the prohibition of weapons of nature to cause superfluous injury or unnecessary suffering.
The risk of nuclear escalation and the political obstacles to nuclear
disarmament makes the conclusion satisfactory from a critical perspective. (Less)
