Artificiell intelligens i musikbranschen - Förhållandet mellan upphovsrätten och musikaliska kompositioner skapade av artificiell intelligens

Abstract
In recent years, artificial intelligence has started to be used in the process of creating musical compositions. The systems are to a large extent autonomous and can make independent decisions in the creative process. The thesis aims to investigate the relationship between Swedish copyright and the musical compositions that are not created by a human but by a system built on artificial intelligence. The questions of the thesis are if these compositions can be protected by copyright, and also who can be held responsible for infringing previous copyright in a digital environment.

In recent years, artificial intelligence has started to be used in the process of creating musical compositions. The systems are to a large extent autonomous and can make independent decisions in the creative process. The thesis aims to investigate the relationship between Swedish copyright and the musical compositions that are not created by a human but by a system built on artificial intelligence. The questions of the thesis are if these compositions can be protected by copyright, and also who can be held responsible for infringing previous copyright in a digital environment.

The answers have been sought using the legal dogmatic method and a rule of law perspective based on the users of artificial systems. Through the study of the essay, it is shown that musical compositions created by artificial intelligence cannot be protected by copyright according to the present legislation, as it can not fulfill the requirement that the creator has to be able to make creative decisions and stamp the work with his or her personal touch. The discussion also becomes philosophical to some extent, if an intelligent system can be considered to have some sort of awareness.

Regarding infringements in previous copyright in a digital environment, the legal situation is unclear regarding certain usage, such as selling or manufacture music-creating systems. Showing negligence or intent for the unlawful use of these compositions can be the central problem that arises, since the creative process has taken place through a machine and not a human. Which industry an operator works within may become even more important, for example if it is an industry where the operator can be expected to have knowledge about previous musical works.

The development in technology is rapidly moving forward, and it is important that the legislator investigates how creations made by artificial intelligence should be regulated so that the creative incentives do not decrease in society. (Less)

Artificiell intelligens har under de senaste åren börjat att användas vid skapandet av musikaliska kompositioner. Systemen är i lång utsträckning autonoma och kan fatta självständiga beslut vid skapandeprocessen. Uppsatsen ämnar att utreda förhållandet mellan den svenska upphovsrätten och de musikaliska kompositioner som inte skapas av en människa utan av ett system byggt på artificiell intelligens. Diskussionen blir även till viss del filosofisk kring ifall ett intelligent system kan anses ha en slags medvetenhet.

Vid intrång i tidigare upphovsrätt i en digital miljö framgår att rättsläget är oklart angående vissa förfoganden, så som att sälja eller tillverka musikskapande system. Att visa på oaktsamhet eller uppsåt för olaga användning av dessa kompositioner kan bli det stora problem som uppkommer, eftersom skapandeprocessen har skett genom en maskin och inte en människa. Vilken bransch en aktör arbetar inom kan komma att få ännu större betydelse än tidigare, exempelvis om det är en bransch där aktören kan förväntas att känna till tidigare musikaliska verk.

Med tanke på den snabba utveckling som sker inom tekniken är det viktigt att lagstiftaren undersöker hur alster skapade av artificiell intelligens ska regleras för att inte de kreativa incitamenten minskar i samhället. (Less)
