I början av 1800-talet fanns det ingen lagstadgad rätt för mannen att bruka mildare fysiskt våld mot sin hustru, men inte heller något förbud. Det hade fram till 1734 års lag varit tillåtet, så länge hon inte fick synliga skador. Våld i nära relation är ett nutida begrepp och inte något som diskuterades eller användes på 1800-talet. Begreppet har använts i uppsatsen i syfte att studera vilka handlingar i dagens definition av våld i nära relation som reglerades enligt lag. I början av 1800-talet fanns det ingen lagstadgad rätt för mannen att bruka mildare fysiskt våld mot sin hustru, men inte heller något förbud. Det hade fram till 1734 års lag varit tillåtet, så länge hon inte fick synliga skador. Våld i nära relation är ett nutida begrepp och inte något som diskuterades eller användes på 1800-talet. Begreppet har använts i uppsatsen i syfte att studera vilka handlingar i dagens definition av våld i nära relation som reglerades enligt lag. Våld i nära relation har även studerats mot bakgrund av äktenskapets inverkan, dels på den rättsliga regleringen av våldet men också på synen angående våld i nära relation. Ett rättsutvecklingsperspektiv och ett genusperspektiv har använts för att studera ämnet och analysera materialet.

Våld i nära relation består av flera olika handlingar och det var enbart fysiskt våld som i viss mån diskuterades under 1800-talet. Troligen fanns det inte en medvetenhet kring våldet och det fanns i vart fall inte någon förståelse för våldets orsak, omfattning och konsekvens. Mannen kunde, utan att utsättas för rättsliga konsekvenser, göra livet svårt för sin hustru genom exempelvis mildare våld, kränkningar och sexuella handlingar emot hennes vilja. Rättsutvecklingen tillsammans med samhällsstrukturer gjorde att kvinnans rättigheter inte diskuterades, utan fokus lades på vad mannen fick och inte fick göra mot sin hustru och inte vad hustrun hade rätt att undkomma.

Under 1800-talet går det att se en förändrad attityd men egentligen utvecklades inget direkt skydd för kvinnorna. Skilsmässolagstiftningen vid misshandel diskuterades men i avgörande delar blev bevarandet av äktenskapet viktigare. Det skedde på 1860-talet en rättslig förändring när all fysisk misshandel av maka kriminaliserades, även sådan som inte gav synliga skador. Att misshandeln inte föll under allmänt åtal ledde till att debatten fortsatte att tystas ner. Under 1800-talet var könsfördelningen tydlig och det var männen som stod för all makt och kontroll i samhället. Det är troligen en av anledningarna till att få förändringar skedde till förmån för den våldsutsatta kvinnan. (Less)

In the early 19th century, there was no statutory right for a man to use milder physical violence against his wife, but no prohibition. It had been allowed until the 1734 law, as long as she did not receive visible injuries. Violence in close relationship is a contemporary concept and not something that was discussed or used in the 19th century. The term has been used in the paper in order to study which actions in the current definition of violence in close relation that were regulated by law. Violence in close relation has also been studied in the light of the impact of marriage, partly on the legal regulation of violence, but also on the view of violence in close relation. In the early 19th century, there was no statutory right for a man to use milder physical violence against his wife, but no prohibition. It had been allowed until the 1734 law, as long as she did not receive visible injuries. Violence in close relationship is a contemporary concept and not something that was discussed or used in the 19th century. The term has been used in the paper in order to study which actions in the current definition of violence in close relation that were regulated by law. Violence in close relation has also been studied in the light of the impact of marriage, partly on the legal regulation of violence, but also on the view of violence in close relation. A legal development perspective and a gender perspective have been used to study the subject and analyse the material.

Violence in close relationship consists of several different actions, and it was only physical violence that was to some extent discussed during the 19th century. Probably there was no awareness of the violence, and in any case there was no understanding of the cause, extent and consequences of violence. The man, without being subject to legal consequences, could make life difficult for his wife by, for example, milder violence, violations and sexual acts against her will. The development of the law together with social structures meant that women's rights were not discussed but focus was put on what a husband was allowed and not allowed to do to his wife, not what the wife was entitled to escape.

During the 19th century, there was a change in attitude, but no direct safety for women was developed. Divorce law in case of abuse was discussed but in crucial parts the preservation of marriage became more important. There was a legal change in the 1860s when all physical abuse of spouses was criminalized, even the one that did not cause visible injuries. The fact that the abuse did not fall under public prosecution led to the debate continuing to be silenced. During the 19th century the gender distribution was obvious and men stood for all power and control in society. This is probably one of the reasons few changes occurred to the benefit of the abused woman. (Less)
