Våldsförbudet - en förlegad reglering? - En analys av våldsförbudet i ljuset av hanteringen av dagens internationella konflikter

En av de mest grundläggande bestämmelserna inom internationell rätt är våldsförbudet mellan stater och den vilar på en konstruktion som skapades på 1900-talet efter erfarenheter av två världskrig. Den främjar en stark statskoncentration med fokus på staters suveränitet.

Övervägande del av dagens väpnade konflikter är interna och inte mellan stater som det var förr. Det har satt press på aktörerna på den internationella arenan att agera. En av de mest grundläggande bestämmelserna inom internationell rätt är våldsförbudet mellan stater och den vilar på en konstruktion som skapades på 1900-talet efter erfarenheter av två världskrig. Den främjar en stark statskoncentration med fokus på staters suveränitet.

Övervägande del av dagens väpnade konflikter är interna och inte mellan stater som det var förr. Det har satt press på aktörerna på den internationella arenan att agera. Organisationer som Förenta Nationerna (FN) och North Atlantic Treaty Organization (NATO) är två bidragande aktörer som utvecklats för att vidta adekvata åtgärder vid en konflikt i syfte att bibehålla internationell fred och säkerhet. Detta inom ramen för de något föråldrade internationella regleringarna.

Vid konflikter där laglig våldsanvändning anses rättfärdigad kolliderar den starka suveränitetsprincipen många gånger med andra intressen som kan uppfattas väga tyngre med hänvisning till rättvisa och moraliska uppfattningar om rätt och fel. Ett aktuellt exempel på detta är några av NATO:s militära väpnade insatser som en del påstår har varit i gråzonen vad gäller konformiteten med våldsförbudets regleringar och dess undantag. Det leder i sin tur till frågeställningar om våldsförbudet är en förlegad reglering och behöver justeras eller till och med tas bort? Det är vad denna uppsats ska besvara.

Utvecklingen har lett till ett slags rättfärdigande bland stater genom doktrinen ”Responsibility to Protect” (R2P). Hanteringen av nutidens konflikter visar en tydlig förändring som skett sedan FN-stadgan bildades. Att en justering i lagstiftningen och dess våldsförbud behövs påvisas genom denna doktrin. För att kunna handskas med interna konflikter måste man frångå tanken på den starka suveräniteten hos stater för att istället lägga fokus på individerna och samhället i stort. (Less)

One of the most fundamental provisions of international law is the prohibition of use of force between states and it rests on a construction created in the 20th century after experiences of two world wars. It affirms a strong government concentration focusing on the sovereignty of states.

Most of today’s armed conflicts are domestic and not between states as it used to be. It has put pressure on actors in the international arena to take action. Organizations such as the United Nations (UN) and the North Atlantic Treaty Organization (NATO) are two contributing organizations developed to take adequate actions in conflicts in order to maintain international peace and security. One of the most fundamental provisions of international law is the prohibition of use of force between states and it rests on a construction created in the 20th century after experiences of two world wars. It affirms a strong government concentration focusing on the sovereignty of states.

Most of today’s armed conflicts are domestic and not between states as it used to be. It has put pressure on actors in the international arena to take action. Organizations such as the United Nations (UN) and the North Atlantic Treaty Organization (NATO) are two contributing organizations developed to take adequate actions in conflicts in order to maintain international peace and security. This within the framework of the somewhat outdated international regulations.

In conflicts where, legal force is considered justified, the strong principle of sovereignty many times collides with other interests that may be considered having more density in regard to fairness and moral perceptions of right and wrong. One current example of this is some of NATO’s armed military interventions which some claim have been in the grey zone in terms of conformity with the prohibition of use of force and its exemptions. This leads to questions about whether the prohibition is a misguided regulation and needs to be adjusted or even removed? That’s what this essay will answer.

Among states a development has led to a kind of justification through the doctrine of “Responsibility to Protect” (R2P). The management of today’s conflicts shows a clear change that has taken place since the establishment of the UN Charter. That an amendment of the legislation and its prohibition of use of force is needed is demonstrated by this doctrine. In order to be able to deal with domestic conflicts one must deny the idea of the strong sovereignty of states to focus on individuals in society at large instead. (Less)
