Hedersmotivs påverkan vid påföljdsbestämning av mordfall

Abstract
Honour is in certain cultures used as a sort of measurement of a person, family or other association social value in the eyes of others and can be lost as well as gained. Men is considered to possess honour and women considered to possess shame. Men’s honour is therefore dependent on their control of, or lack there of, women’s dishonourable behavior. Honour related violence can in general terms be described as violence which is used to reestablish lost honour.
The possibility to consider honour motives in relation to the value of a punishment (straffvärde) exists within Swedish legislation. There is no other expressed possibility to use this kind of motives as means to mitigate or aggravate punishment. Cases of honour related violence... (More)
Honour is in certain cultures used as a sort of measurement of a person, family or other association social value in the eyes of others and can be lost as well as gained. Men is considered to possess honour and women considered to possess shame. Men’s honour is therefore dependent on their control of, or lack there of, women’s dishonourable behavior. Honour related violence can in general terms be described as violence which is used to reestablish lost honour.
The possibility to consider honour motives in relation to the value of a punishment (straffvärde) exists within Swedish legislation. There is no other expressed possibility to use this kind of motives as means to mitigate or aggravate punishment. Cases of honour related violence are however connectable to other aggravating circumstances due to its course of action with a specific focus on the close relation between victims and their perpetrators. The courses of action are also harsh to a point of applicability of other aggravating circumstances.
Courts have in recent years gone from using synonyms and not explaining their effect on judgement to using honour by its name and explaining its position as an aggravating circumstance in itself. They have also suggested that it can not be used as a mitigating circumstance while establishing value of punishment (straffvärdering). They have although expressed that the perpetrators cultural background can be used as such when measuring a particular punishment (straffmätning). Due to inadequate argumentation the legal position is still slightly unclear.
By now considering honour motives as an aggravating circumstance in courts I consider the Swedish application of laws to be in correlation with demands set up by the principle of legality (legalitetsprincipen) in criminal justice in relation to murder at least. The legal position is still somewhat unclear and should be clarified by a ruling of Sweden’s supreme court or by new legislation. (Less)

Tillvägagångssätten är även i övrigt så pass grova att ett flertal försvårande omständigheter kan tillämpas.
Domstolar har från att endast benämna heder i synonymer och inte förklara dess påverkan vid påföljdsbestämning gått till att benämna det uttryckligen och förklara dess ställning som försvårande omständighet vid straffvärdering på senare dagar. De har också antytt att hedersmotiv inte ska kunna användas som förmildrande omständighet vid straffvärdering. De har dock uttryckt visst stöd för att en utländsk kulturs påverkan på gärningsman kan användas som lindrande vid straffmätning. På grund av bristfällig argumentation i sina domskäl är rättsläget på denna punkt fortfarande något oklart.
Genom att numera beakta hedersmotiv som försvårande omständighet i domstolar anser jag att svensk rättstillämpning är i korrelation med de krav som ställs upp av den straffrättsliga legalitetsprincipen i vart fall gällande mord. Rättsläget hade dock behövts tydliggöras genom dom i Högsta domstolen alternativt särregleras. (Less)
