Denna uppsats handlar om en princip som vuxit fram inom folkrätten de senaste decennierna, kallad Responsibility to protect (R2P). Den är en undantagsregel till suveränitetsprincipen och innebär i korthet att om en stat inte kan eller vill skydda sin befolkning från vissa specifikt
stadgade brott, har den internationella gemenskapen en möjlighet att intervenera i ett land, utan landets tillstånd.

De senaste decenniernas terroristattacker i världen, flera av dessa utförda i religionens namn, har föranlett den kinesiska regeringen att påbörja sitt eget krig mot terrorism. stadgade brott, har den internationella gemenskapen en möjlighet att intervenera i ett land, utan landets tillstånd.

De senaste decenniernas terroristattacker i världen, flera av dessa utförda i religionens namn, har föranlett den kinesiska regeringen att påbörja sitt eget krig mot terrorism. Den kinesiska regimen sägs vilja vidta försiktighetsåtgärder, i syfte att förhindra framtida attacker kopplade till religion. En av de drabbade grupperna är uigurerna. De tillhör en muslimsk minoritetsbefolkning som lever i Xinjiang, i Kinas nordvästra del. Satellitbilder tagna ovanför regionen, visar läger som sägs internera uigurer av enbart religiösa anledningar. Det hävdas
att begränsningar för uigurerna har införts i regionen, och deras rätt till religionsfrihet sägs ha inskränkts.

Syftet med uppsatsen är att undersöka om R2P kan tillämpas i Kina. I arbetet bortser jag huvudsakligen från Kinas rätt att lägga in sitt veto i säkerhetsrådet. Metoden som används är en blandning av rättsdogmatisk och rättsanalytisk, för att undersöka om det utifrån dagens ställda kriterier, och mot bakgrund av säkerhetsrådets ageranden i Syrien och Libyen, går att motivera ett ingripande.

Arbetet kommer fram till att Kinas behandling av uigurerna hamnar under R2P-brottet etnisk rensning. Kina har i första hand ansvaret att skydda sin befolkning mot detta. Eftersom den kinesiska staten inte vill göra någonting åt detta, tillkommer ansvaret den internationella gemenskapen.

Uppsatsens slår fast att ett ingripande med stöd av R2P, trots det ovan sagda, inte kan ske utifrån dagens förutsättningar för principens tillämpning. (Less)

This essay is about a principle in international law that has emerged in the last decades, called Responsibility to protect (R2P). It constitutes an exception to state sovereignty. In short, if a state is unable or unwilling to protect its citizens from some specific crimes, the international community is given an opportunity to intervene in that state without the state’s consent.

The Chinese government has been prompted to start its own war against terrorism, by the last decades of terrorist attacks, many of them carried out in the name of religion. Allegedly, the Chinese regime has taken some preemptive action in preventing terrorist attacks connected to religion. One of the affected groups are the Uyghurs, a Muslim minority living in... (More)
This essay is about a principle in international law that has emerged in the last decades, called Responsibility to protect (R2P). It constitutes an exception to state sovereignty. In short, if a state is unable or unwilling to protect its citizens from some specific crimes, the international community is given an opportunity to intervene in that state without the state’s consent.

The Chinese government has been prompted to start its own war against terrorism, by the last decades of terrorist attacks, many of them carried out in the name of religion. Allegedly, the Chinese regime has taken some preemptive action in preventing terrorist attacks connected to religion. One of the affected groups are the Uyghurs, a Muslim minority living in Xinjiang, which is situated in the north western part of the country. Satellite pictures taken above the region have shown newly constructed compounds, which are thought to house Uyghurs because of their religious beliefs. It is said that restrictions have been imposed in Xinjiang, and the Uyghurs right to religion has been limited.

The aim of this work is to investigate if an intervention based on R2P is possible in China, in which I will mainly exclude China’s right to veto in the Security Council. The methods used are a legal dogmatic method and a legal analytical method. Based on the criteria for the use of R2P and from the perspective of how the Security Council acted in Syria and Libya, I will investigate if an intervention in Xinjiang is possible.

The paper concludes that the Chinese treatment of the Uyghurs amounts to ethnic cleansing. China has the primary responsibility to protect its population against this situation. Since the Chinese government seems indolent toward this fact, the responsibility accrues to the international community.

The essay foresees that an intervention on the basis of R2P, despite the aforementioned, is ruled out on the basis of today’s criteria for the use of the principle. (Less)
