En vägrad handskakning med personer av motsatt kön med hänvisning till religiös övertygelse har varit en återkommande anledning till debatt i Sverige under de senaste åren. Hur långtgående är begränsningen av den enskildas religionsfrihet? Hur görs avvägningen mellan jämställdhetsintressen och religionsfrihetsintressen? Räknas handskakning som religiös manifestation? Fram till våren 2018 hade ingen högre instans prövat handskakningskrav i sak. AD 2018 nr 51 välkomnades därför med öppna armar. Fallet handlade om en kvinna som sökte jobb på ett tolkföretag. Hur långtgående är begränsningen av den enskildas religionsfrihet? Hur görs avvägningen mellan jämställdhetsintressen och religionsfrihetsintressen? Räknas handskakning som religiös manifestation? Fram till våren 2018 hade ingen högre instans prövat handskakningskrav i sak. AD 2018 nr 51 välkomnades därför med öppna armar. Fallet handlade om en kvinna som sökte jobb på ett tolkföretag. Arbetsdomstolen (AD) stadgade då att genom att avbryta anställningsförfarandet, diskriminerades kvinnan.

Uppsatsen syftar till att bland annat undersöka hur utrymmet ser ut, i ljuset av detta rättsfall, för arbetsgivare att kunna ställa krav på handskakning oavsett kön på arbetsplatsen. Det görs i ljuset av både svensk och europeisk reglering och praxis.

Det finns begränsad rättspraxis i svensk rätt kring handskakning och kring religionsfrihet på arbetsplatsen. I det s.k barnmorskefallet och tandläkar-fallet har dock AD bedömt det proportionerligt att begränsa den enskildas religionsfrihet för allmänna intressen. Europadomstolen har också avgjort fall om religionsfrihet i arbetslivet där de i många fall starkt betonat vikten av jämställdhetsintresset.

Det finns mycket i AD:s domskäl som fortfarande är öppna för diskussion och dessutom finns det skiljaktiga meningar till domen. Europadomstolen och EU-domstolens praxis ger en öppning för arbetsgivare att kunna ställa ett allmänt likabehandlingskrav och därmed krav på handskakning oavsett kön. (Less)

A declined handshake with people of opposite sex because of their religious belief has been a reason for recurrent debate in Sweden the past couple of years. How far can you limit the freedom to exercise one’s religion? How do you balance the interests of equality and freedom of religion? Does handshake count as a religious manifestation? Up until Spring of 2018 no higher court had ruled on the facts. AD 2018 no. 51 was therefore welcomed with open arms. The case was about a woman applying for a job. In the interview she declined to shake hands with the male employer because of her religious belief and the company immediately told her to leave. The purpose of the thesis is, among others, to examine whether or not employers have the possibility to require all of their employees and job-seeking to shake hands with each other irrespective of sex. This will be seen in the light of both Swedish and European regulation and case-law.

There is limited case-law in Sweden about handshake and freedom of religion in the workplace. In the so called “barnmorskefallet” and ”tandläkarfallet”, The Swedish Labour Court had assessed that it was proportional to limit the freedom to manifest one’s religion for the good of public interests. The European Court of Human Rights has also ruled on cases about freedom of religion in the workplace where they have in many cases strongly emphasized the weight of equal treatment.

There is a lot in The Swedish Labour Court’s grounds which are still open for discussion and there are also dissenting opinions in the case. The case-law of The European Court of Human Right and the Court of Justice of the European Union gives an opening and possibility for employers to be able to demand a public equal-treatment-requirement and therefore also a requirement of handshake with everyone irrespective of sex.
