- Sedan 2010 är föräldrar som är vårdnadshavare solidariskt skadeståndsskyldiga med sina barn för skador som barnen orsakat genom brott. Ansvaret är begränsat till sak- och personskador samt skador genom kränkning, och skadeståndets storlek begränsat till en femtedels prisbasbelopp per skadehändelse. Regeln infördes trots, och utan hänsyn till, den omfattande kritik som framfördes av otaliga remissinstanser.
I uppsatsen undersöks hur reglerna om föräldrars skadeståndsansvar tillämpas, med ett särskilt fokus på utfallet för resurssvaga föräldrar. Det görs en jämförelse med motsvarande regler i Norge och Danmark och möjligheterna för föräldrar att försäkra sig mot skadeståndsskyldigheten ifråga undersöks.

För att besvara de olika frågeställningarna har en omfattande empirisk studie gjorts. I denna har 334 skadeståndsdomar från 2018 granskats. Resultatet av undersökningen visar att föräldrar i socialt utsatta områden i högre utsträckning döms att betala skadestånd solidariskt med sina barn och att det i högre utsträckning är mammor som ensamma döms att betala. Möjligheterna till jämkning av skadestånden är begränsade. Den empiriska undersökningen visar att en förälders svaga ekonomi ytterst sällan utgör grund för jämkning. (Less) - Abstract

The essay examines how the rules on parental liability are applied, with a particular focus on the outcome for parents with limited resources. A comparison is made with the corresponding rules in Norway and Denmark, and the possibilities for parents to insure themselves against the liability in... The essay examines how the rules on parental liability are applied, with a particular focus on the outcome for parents with limited resources. A comparison is made with the corresponding rules in Norway and Denmark, and the possibilities for parents to insure themselves against the liability in question are examined.
To answer the various questions an extensive empirical study has been conducted. In the study 334 tort judgments from 2018 have been reviewed. The result of the survey shows that parents in socially vulnerable areas are to a greater extent convicted of paying damages jointly with their children and that it is to a greater extent the mothers who are solely sentenced to pay. The possibilities for adjusting the damages are limited. The empirical study shows that a parent's weak economy rarely forms the basis for adjustment. (Less)
