- Syfte/Material: Denna studie undersöker diskussionen om läkemedelspatent och tillgång till läkemedel. Genom att studera läkemedelsfrågans nyckelaktörer samt hur dessa formulerar och använder rättighetsbegreppet syftar denna studie att undersöka hur frågan kan betraktas utifrån ett rättighetsperspektiv. Undersökningens empiriska material består av en FN-rapport om tillgång till läkemedel från 2016 samt de förslag som mottogs inför rapportens publikation. I den följande undersökningen utförs en induktiv kvalitativ innehållsanalys för att identifiera de kategorier inom vilka rättighetsbegreppet formuleras och används av studiens aktörer. Resultat: Undersökningens resultat finner att rättighetsbegreppet formuleras inom fyra olika huvudteman: motstridiga problembeskrivningar, konflikten mellan rättigheter, internationella handelsavtal samt frånvaron av rättighetsperspektivet. Slutsats: Studien drar slutsatsen att rättighetsbegreppet formuleras och används av samtliga inblandade aktörer med olika syften och intressen. En huvudsaklig slutsats är att rättighetsperspektivet i flera hänseenden är frånvarande i det undersökta materialet. Slutligen förs en diskussion över rättighetspråkets potential och motståndskraft mot bakgrund av studiens resultat. (Less)

By examining the conflict’s key actors and how they formulate and use the concept of rights, the purpose of this study is to answer how the pharmaceutical debate can be understood from a rights perspective. The material consists of a UN report on access to medicine published in 2016 including the proposals submitted prior to its publication. The material consists of a UN report on access to medicine published in 2016 including the proposals submitted prior to its publication. In the following examination an inductive qualitative content analysis is used to identify categories within which the concept of rights are formulated and used. Results: The results of the study find that the concept of rights are formulated within four different themes: conflicting problem descriptions, the conflict of rights, international trade deals and the absence of a rights perspective. Conclusion: The study draws the conclusion that the concept of rights is formulated by all included participants but by different purposes and interests. One main conclusion is that the rights perspective in many regards is absent in the examined material. A final discussion addresses the potential and resistance of the language of rights against the background of the results presented. (Less)
