When in trial everyone is supposed to be equal to the law. The aim of this study was from a gender perspective to explore how the childs legal guardian was described in judgments of 1 and 2§§ LVU. When in trial everyone is supposed to be equal to the law. The aim of this study was from a gender perspective to explore how the childs legal guardian was described in judgments of 1 and 2§§ LVU. The method for this study was a qualitative study based on a content analysis. Our selection for this study was 29 judgement from the Swedish court, known as förvaltningsrätten. All of the judgements were from 2018 and from förvaltningsrätten in Malmö. To analyse our result we used Yvonne Hirdmans theory gendersystem. The main result of this study was that förvaltningsrätten make differences due to gender in LVU judgements. There are different description between the characteristics of men and women that leads to unequal judgement. There are also an inequality when describing violence towards the child. In some cases the violence are described more than others. When it is honour violence it is taken more seriously. In the cases of honour violence the fathers violence becomes more prominent and while the mothers violence has a tendency to be diminished. In other families there is a tendency to describe violence as arguments and fractions. Another finding is that fathers when present and willing to take care of his child has high demands on him. He does not have the same expectations on him as a parent like the mother has. The mother is expected to take care of the child and when she does not, the blame is on her. The mother also has to take the blame for the fathers difficulties. This findings is consistent with the gendersystem since this is the normative way of looking at families. Men are superior women and men and women are supposed to be kept apart according to Hirdmans gendersystem. (Less)
