Abstract
The aim of this study was to understand how the social rights of social assistance claimants are made in the relationship between the individual and the state, and of what importance this has for the claimant. Social assistance claimants are a vulnerable group in society that depends on the safety net of the state. The study is based on a qualitative text analysis of 13 legal cases from the Supreme Administrative Court (Swedish: Högsta förvaltningsdomstolen) in Sweden from 1984 to 2017. The aim of this study was to understand how the social rights of social assistance claimants are made in the relationship between the individual and the state, and of what importance this has for the claimant. Social assistance claimants are a vulnerable group in society that depends on the safety net of the state. In this study, social rights are represented as the responsibility of the individual to plan their finances and to be available for work. The result shows that social assistance cannot be regarded as an absolute right for the claimant. Furthermore, the results show that the recipient has limited opportunities for freedom of choice in their life and lack of predictability in their financial situation. (Less)
