Abstract (Swedish)
Arbetsmiljölagen är en generellt formulerad ramlag som tillkom på 1970-talet. I det moderna arbetslivet har många av de arbetsmiljörelaterade problem som kan uppstå ändrat karaktär och skaderisken flyttas mer och mer från den fysiska till den psykosociala arbetsmiljön. I takt med att denna utveckling sker uppstår behovet av att göra nya tolkningar av hur lagen ska appliceras. Den här uppsatsen undersöker hur skyddsombudens stoppningsrätt kan användas i förhållande till psykosociala arbetsmiljöfaktorer. Det finns mycket lite tidigare forskning på detta område, varför syftet med uppsatsen är att ge exempel på hur Arbetsmiljöverket respektive skyddsombud behandlar frågan, samt öppna upp för en diskussion kring ämnet.

Den här uppsatsen undersöker hur skyddsombudens stoppningsrätt kan användas i förhållande till psykosociala arbetsmiljöfaktorer. Det finns mycket lite tidigare forskning på detta område, varför syftet med uppsatsen är att ge exempel på hur Arbetsmiljöverket respektive skyddsombud behandlar frågan, samt öppna upp för en diskussion kring ämnet.
I uppsatsen granskas och jämförs beslut från Arbetsmiljöverket gällande skyddsombudsstopp som lagts på grund av psykosociala risker i arbetet så som oro, stress, brister i det psykosociala arbetsmiljöklimatet och ensamarbete. Begreppet psykosocial arbetsmiljö är problematiskt att definiera och det framkommer av den forskning jag tagit del av att det inte finns någon enhetlig tolkning av vad det bör innefatta. Detta kan enligt mig göra att en enhetlig bedömning av skyddsombudsstoppets lovlighet och av hur akut fara som ska anses ha förelegat kan vara svår att göra för en utomstående representant för en myndighet eller domstol. The Work Environment Act is formulated in general terms and originates from the 1970s. In the modern work life many of the work environment related problems that can emerge has changed in character, and the risk of injury has changed from the physical to the psychosocial work environment. As this development takes place the need for new interpretations on how the Act should be applied occurs. The Work Environment Act is formulated in general terms and originates from the 1970s. In the modern work life many of the work environment related problems that can emerge has changed in character, and the risk of injury has changed from the physical to the psychosocial work environment. As this development takes place the need for new interpretations on how the Act should be applied occurs. This essay investigates how the safety representatives can use their right to suspend work in relation to psychosocial factors in the work environment. There is a lack of research in this field, wherefore the purpose of this essay is to present examples of how the Swedish Work Environment Authority and the safety representatives address the issue and open up for a discussion about the subject.
The essay examines and compares decisions from the Swedish Work Environment Authority concerning safety representative work suspensions due to psychosocial risks in the work environment such as anxiety, stress, deficiencies in the psychosocial work environment climate and risks associated with working alone. The concept of psychosocial work environment is problematic to define, and it is evident from the research I have studied that there is no uniform interpretation of what it should include. This can, in my view, mean that a uniform assessment of the legality of the safety representative work suspension and of the urgency of danger that may be difficult to do for a third-party representative of an authority or court.
