Abstract (Swedish)
I denna uppsats behandlas Lagen (2016:749) om särskilt skydd mot repressalier för arbetstagare som slår larm om allvarliga missförhållanden och hur den tillämpas på inhyrda arbetstagare. Syftet med uppsatsen är att få en förståelse för hur inhyrda arbetstagare påverkas av den nya lagstiftningen och hur andra rättskällor kan komma att påverkas av lagens uppkomst. Detta för att se hur skyddet för inhyrda arbetstagare kan uppnås genom andra medel än visselblåsarlagen. I uppsatsen har vi valt att använda oss av den traditionella rättsdogmatiska metoden. I denna uppsats behandlas Lagen (2016:749) om särskilt skydd mot repressalier för arbetstagare som slår larm om allvarliga missförhållanden och hur den tillämpas på inhyrda arbetstagare. Syftet med uppsatsen är att få en förståelse för hur inhyrda arbetstagare påverkas av den nya lagstiftningen och hur andra rättskällor kan komma att påverkas av lagens uppkomst. Detta för att se hur skyddet för inhyrda arbetstagare kan uppnås genom andra medel än visselblåsarlagen. I uppsatsen har vi valt att använda oss av den traditionella rättsdogmatiska metoden. Genom denna metod har vi undersökt gällande rättskällor för att tolka och tillskansa oss en förståelse över hur lagens tillämpning kan komma att se ut i framtiden. Detta för att se hur det faktiska skyddet just nu ser ut för inhyrda arbetstagare som slår larm i inhyrarens verksamhet. Vi har valt att avgränsa oss till att endast beröra tjänstemän och därför exkluderat arbetare i denna uppsats. Vi har använt oss av befintligt material som varit tillgängligt för oss, bland annat förarbeten till flertalet lagar, däribland Lagen (2018:558) om företagshemligheter. Vi har även använt oss av avhandlingar, aktuella kollektivavtal och övrig doktrin som skrivits i ändamålet att beröra visselblåsning på den svenska arbetsmarknaden. (Less)

In this essay we are addressing a relatively new Swedish statute named Lagen (2016:749) om särskilt skydd mot repressalier för arbetstagare som slår larm om allvarliga missförhållanden [special protection for workers who report gross misconduct], and how it applies to hired workers. Our purpose with this essay is to achieve an understanding on how hired workers are affected by the new statute and how other legislation may be affected by the implementation of this statute. We’ve done this to see how the protection of hired workers may be implemented by other means than this particular statute. In this essay we are addressing a relatively new Swedish statute named Lagen (2016:749) om särskilt skydd mot repressalier för arbetstagare som slår larm om allvarliga missförhållanden [special protection for workers who report gross misconduct], and how it applies to hired workers. Our purpose with this essay is to achieve an understanding on how hired workers are affected by the new statute and how other legislation may be affected by the implementation of this statute. We’ve done this to see how the protection of hired workers may be implemented by other means than this particular statute. For this essay we’ve mainly been using the traditional legal dogmatic method. Through this method we’ve studied sources of law that are currently in use in the Swedish legal system. By interpreting these we want to achieve an understanding for how the statute’s application may be applied by Swedish courts in the future. We’ve also used this to understand what the actual protection for hired workers currently looks like. We’ve decided to delimit ourselves in this essay to only refer to white-collar workers. We’ve made use of material currently available to us and material that is constituting the current jurisprudence in Swedish Law, including preparatory work for other statutes such as Lagen (2018:558) om företagshemligheter [company secrets]. We’ve also made use of other people’s thesis, currently active collective agreements and other sources of doctrine which has been written to refer to whistleblowing on the Swedish labour market.
