Abstract (Swedish)
Uppsatsens syfte är att beskriva och analysera 1600-talets legala och teologiska syn på trolldomsbrottet. Uppsatsen använder en rättshistorisk litteraturstudiemetod och applicerar ett Law and religion-perspektiv.
Arbetet redogör för den juridiska beskrivningen och det juridiska lagstiftningsläget under århundrandet, samt vilken koppling kyrkan har haft till lagverken och definitionen på trolldomsbrottet. Arbetet fokuserar på att beskriva vilka olika definitioner som magi-begreppet kunde ha under 1600-talet och hur man skiljer på oskadlig och skadlig magi. Arbetet fokuserar på att beskriva vilka olika definitioner som magi-begreppet kunde ha under 1600-talet och hur man skiljer på oskadlig och skadlig magi. De världsliga myndigheterna hade ett större intresse att få kontroll på bruket av den skadliga magin, d.v.s. förgöring, maleficium, eller trolldom som det kallas i lagtexten. Den oskadliga magin, som vidskepelse var inte brottslig och den världsliga makten hade inte något större intresse av att reglera och motverka denna formen av magi, eftersom ingen kom till skada av den. Den religiösa makten hade däremot en annan uppfattning. De såg även den oskadliga magin som avgudadyrkan och farlig för folksjälen, och var ur ett kristet perspektiv oacceptabelt. I försök att få den eftertraktade moraliska efterlevnad som den kristna religionen krävde, predikade kyrkan att den oskadliga formen av magi var lika förbjuden som den skadliga, och att all form av magi innebar en förbindelse till Satan. Abstract
The paper discusses the legal definition of the Swedish crime, sorcery, under the 17th century, but also the Christian influences on what content the protestant church wanted the crime to include. The essay applies a law and religion perspective.
The legal definition on what was considered criminal through sorcery was based on the actual physical damage that the sorcery caused. The church, who had a wish to control and oppress the Swedish folklore and culture, however, wanted to emphasise a connection between the witches and the Devil. The people that practiced witchcraft also were presumed to have a pact with the Dark Lord and therefore was a threat to the whole country. The paper discusses the legal definition of the Swedish crime, sorcery, under the 17th century, but also the Christian influences on what content the protestant church wanted the crime to include. The essay applies a law and religion perspective.
The legal definition on what was considered criminal through sorcery was based on the actual physical damage that the sorcery caused. The church, who had a wish to control and oppress the Swedish folklore and culture, however, wanted to emphasise a connection between the witches and the Devil. The people that practiced witchcraft also were presumed to have a pact with the Dark Lord and therefore was a threat to the whole country. It was believed that God would punish a whole nation because of a few individuals and it was the church’s responsibility to counteract and stop the sinners from enraging the non-forgiving and ruthless God. This essay analysis the balance between the importance of the actual physical damage that the law requested for an actual enforcement and the churches constant attempt of control over a nation who still used and believed in a more primitive folklore, by condemning their use of harmless magic, and connecting it with evil.
