Abstract
This thesis discusses the differences in case of dismissal in forms of personal matters such as
misconduct and illness in Sweden and England. The purpose is to see how the dismissal takes
place before and during the dismissal in the two countries. In order to do this comparative
study, the legal dogmatic method have been used. The sources of law that have been used is
primarily precedents, the two countries legislations and doctrine.

The conclusion of the thesis is that both Sweden and England uses precedents to solve
disputes in court but the difference is that in Sweden there are more legislation to rely on than
in England, which can be seen as a protection for the employee. A sick employee in Sweden

misconduct and illness in Sweden and England. The purpose is to see how the dismissal takes
place before and during the dismissal in the two countries. In order to do this comparative

The conclusion of the thesis is that both Sweden and England uses precedents to solve
disputes in court but the difference is that in Sweden there are more legislation to rely on than
in England, which can be seen as a protection for the employee. A sick employee in Sweden
is protected by the statutory rehabilitation obligation as well as the redeployment obligation.
In the English law the primarily focus is the communication between the employer and the
employee. If an employee is in a misconduct an employer in Sweden still has the
redeployment obligation towards the employee before dismissing him/her. However, the
period of the employment of the employee in question and the size of the company takes into
consideration when deciding how much action one can demand the employer to take. An
employer in England does not have to consider whether redeployment is relevant or not but
there has to be a conversation between the employer and the employee before a dismissal is
relevant. The thesis also discusses the regulations regarding alcohol at work in forms of

Den här komparativa studien redogör för skillnaderna mellan Sverige och England vid uppsägningsfall som hänför sig till personliga skäl, specifikt misskötsamhet och sjukdom. Syftet är att se hur de båda länderna skiljer sig åt innan och vid uppsägningsfall som hänför sig till personliga skäl. För att göra jämförelsen är studien grundad i en rättsdogmatisk metod. De rättskällor som främst använts är praxis, lagtexter samt doktrin.

Slutsatsen av studien är att både Sverige och England använder sig av praxis för att lösa tvister men skillnaden blir att Sverige har fler lagar att falla tillbaka på än England, vilket kan uppfattas som ett starkare skydd för arbetstagaren. Den här komparativa studien redogör för skillnaderna mellan Sverige och England vid uppsägningsfall som hänför sig till personliga skäl, specifikt misskötsamhet och sjukdom. Syftet är att se hur de båda länderna skiljer sig åt innan och vid uppsägningsfall som hänför sig till personliga skäl. För att göra jämförelsen är studien grundad i en rättsdogmatisk metod. De rättskällor som främst använts är praxis, lagtexter samt doktrin.

Slutsatsen av studien är att både Sverige och England använder sig av praxis för att lösa tvister men skillnaden blir att Sverige har fler lagar att falla tillbaka på än England, vilket kan uppfattas som ett starkare skydd för arbetstagaren. I Sverige är den sjuke arbetstagaren skyddad av den lagstadgade rehabiliteringsskyldigheten samt omplaceringsskyldigheten. I engelsk rätt ligger fokus på kommunikationen mellan arbetsgivaren och arbetstagaren. Vid misskötsamhet har arbetsgivaren i svensk rätt fortfarande ett ansvar att omplacera arbetstagaren, men med anställningstid och företagets storlek i åtanke kan det krävas olika stora insatser. I England måste inte arbetsgivaren utreda omplaceringsmöjligheten, men det ska föras en konversation med arbetstagaren innan uppsägning är aktuellt. Studien redogör även för de regleringar som finns vid alkohol på arbetsplatser i form av sjukdom eller misskötsamhet. (Less)
