I denna uppsats undersöks svensk rätts förståelse av prostitution och surrogatmödraskap ur ett radikalfeministiskt perspektiv. Mot bakgrund av den radikalfeministiska utgångspunkten att prostitution och surrogatmödraskap är jämförbara med varandra, granskar uppsatsen hur en radikalfeministisk diskurs tar sig uttryck i SOU 1995:15 och SOU 2016:11. Genom viss rättsdogmatik, men framför allt genom att använda en förenklad variant av Carol Bacchis diskursanalytiska metod What is the problem represented to be?, tydliggörs hur utredarens framställning av prostitution respektive surrogatmödraskap relaterar till radikalfeministisk teori.

I denna uppsats undersöks svensk rätts förståelse av prostitution och surrogatmödraskap ur ett radikalfeministiskt perspektiv. Mot bakgrund av den radikalfeministiska utgångspunkten att prostitution och surrogatmödraskap är jämförbara med varandra, granskar uppsatsen hur en radikalfeministisk diskurs tar sig uttryck i SOU 1995:15 och SOU 2016:11. Genom viss rättsdogmatik, men framför allt genom att använda en förenklad variant av Carol Bacchis diskursanalytiska metod What is the problem represented to be?, tydliggörs hur utredarens framställning av prostitution respektive surrogatmödraskap relaterar till radikalfeministisk teori.

Resultatet av analysen visar att svensk rätts förståelse av prostitution och surrogatmödraskap, ger uttryck för en radikalfeministisk diskurs i båda utredningarna, men i olika grad och på olika sätt. Diskursen är å ena sidan mer omfattande i prostitutionsutredningen än i surrogatmödraskapsutredningen, men å andra sidan stark i de delar av surrogatmödraskapsutredningen som behandlar kvinnans rätt till kontroll över sin egen kropp. Resultatet problematiseras och diskuteras sedan utifrån de begränsningar och effekter som framställningarna kan innebära. Här problematiseras förflyttningen från en strukturell till individualistisk förståelse, och relateras till tidigare forskning av Maud Eduards och Ulrika Andersson.

This essay examines the understanding of prostitution and surrogacy within Swedish law, from a radical feminist perspective. Given the radical feminist standpoint that prostitution and surrogacy are phenomena comparable with each other, the essay analyzes how a radical feminist discourse is conveyed within two official reports of the Swedish government: SOU 1995:15 and SOU 2016:11. By not primarily working using the legal methodology, but by working applying a simplified version of Carol Bacchi’s discourse analytical method What is the problem represented to be?, the essay clarifies how the investigator’s respective representation of prostitution and surrogacy, relates to radical feminist theory.

This essay examines the understanding of prostitution and surrogacy within Swedish law, from a radical feminist perspective. Given the radical feminist standpoint that prostitution and surrogacy are phenomena comparable with each other, the essay analyzes how a radical feminist discourse is conveyed within two official reports of the Swedish government: SOU 1995:15 and SOU 2016:11. On one hand, the discourse is more extensive in the report on prostitution. On the other hand, the discourse is strong in the parts concerning women’s right to bodily autonomy, in the report on surrogacy. The result is problematized and discussed, taken into account limitations and effects that can derive from the problem representations. The shift from a structural to an individualistic understanding is being problematized and compared to prior research by Maud Eduards and Ulrika Andersson.
