Att kriminalisera kärlek - En kritisk analys av motiven bakom förbudet mot samlag med syskon

Samlag med syskon är en gärning som sedan hundratals år tillbaka varit kriminaliserat i Sverige. Det är brottsbalkens sjätte kapitel om sexualbrott som reglerar förbudet. Bestämmelsen, som till en början grundades på religiösa skäl, motiveras idag på grundval av socialetiska och arvsgenetiska skäl. Kriminaliseringen och dess motiv har dock under modern tid kommit att ifrågasättas i ljuset av motstående intressen som den sexuella självbestämmanderätten och principer om kriminalisering.

Samlag med syskon är en gärning som sedan hundratals år tillbaka varit kriminaliserat i Sverige. Det är brottsbalkens sjätte kapitel om sexualbrott som reglerar förbudet. Bestämmelsen, som till en början grundades på religiösa skäl, motiveras idag på grundval av socialetiska och arvsgenetiska skäl. Kriminaliseringen och dess motiv har dock under modern tid kommit att ifrågasättas i ljuset av motstående intressen som den sexuella självbestämmanderätten och principer om kriminalisering.

Uppsatsen utreder och problematiserar motiven till den nuvarande bestämmelsen ur ett komparativt och historiskt perspektiv. Vidare fastställs och tillämpas utarbetade principer om kriminalisering på bestämmelsen för att klarlägga huruvida den kan rättfärdigas i en modern rättsstat.

Resultatet visar på att kriminaliseringen i sig inte är unik i förhållande till övriga Europa, men inte heller en självklarhet eller nödvändighet för andra, med Sverige, jämförbara stater. Detta följs av faktumet att avkriminalisering av samlag med syskon har varit ett vanligt förekommande fenomen i Europa sedan 1800-talet. Vidare dras även slutsatsen att dagens kriminalisering inte lever upp till någon av de kriminaliseringsprinciper som utreds i uppsatsen och därmed inte kan anses vara rättfärdigad. Konsekvensen av detta bör därför vara att förbudet mot samlag med syskon tas bort ur den svenska lagstiftningen. (Less)

Sexual intercourse between siblings is something that has been criminalized in Sweden for hundreds of years. It is The Swedish Penal Code’s sixth chapter on sexual offenses that regulate the prohibition. The regulation, which was initially vindicated with religious motives, is today justified based on motives of social-ethical and hereditary character. However, in modern times the criminalization and its motives have come to be questioned in the light of opposing interests such as the right of sexual self-determination and principles of criminalization.

Sexual intercourse between siblings is something that has been criminalized in Sweden for hundreds of years. It is The Swedish Penal Code’s sixth chapter on sexual offenses that regulate the prohibition. The regulation, which was initially vindicated with religious motives, is today justified based on motives of social-ethical and hereditary character. However, in modern times the criminalization and its motives have come to be questioned in the light of opposing interests such as the right of sexual self-determination and principles of criminalization.

The essay investigates and problematizes the motives for the current regulation from a comparative and historical perspective. Furthermore, elaborated principles of criminalization are established and applied to the regulation to examine whether it can be justified in a modern rule of law.

The results show that criminalization of the act is not unique in relation to the rest of Europe, but on the other hand it is also not a matter of necessity for other, with Sweden, comparable states. This can be observed by the fact that decriminalization of sexual intercourse with siblings has been a common phenomenon in Europe since the 19th century. Furthermore, it is also concluded that today's criminalization does not live up to any of the principles of criminalization that are investigated in the essay and thus cannot be considered justified. The consequence of this should therefore be that the prohibition of sexual intercourse with siblings is removed from the Swedish legislation. (Less)
