Kriminalisering av filmad prostitution - En uppsats avseende det rättsliga förhållandet mellan pornografi och prostitution

I dagsläget regleras såväl prostitution som pornografi inom ramen för brottsbalkens bestämmelser. Skillnader föreligger dock med hänsyn till vilka intressen som ansetts skyddsvärda och vilket behov av kriminalisering som enligt lagstiftaren ansetts föreligga. Endast prostitution är i dagsläget kriminaliserat i svensk rätt. Syftet med förevarande uppsats är att fördjupa förståelsen för vad som anses vara ett straffbart utnyttjande av kroppen och vad som inte anses vara det.

Skillnader föreligger dock med hänsyn till vilka intressen som ansetts skyddsvärda och vilket behov av kriminalisering som enligt lagstiftaren ansetts föreligga. Endast prostitution är i dagsläget kriminaliserat i svensk rätt. Syftet med förevarande uppsats är att fördjupa förståelsen för vad som anses vara ett straffbart utnyttjande av kroppen och vad som inte anses vara det.

I uppsatsen undersöks och problematiseras hur gränsdragningen mellan prostitution och pornografi ser ut i brottsbalkens bestämmelser. Därefter utreds huruvida pornografi, med utgångspunkt i de aktuella skyddsintressena vid prostitution samt radikalfeministisk teori, bör vara kriminaliserat i svensk rätt. Dessa frågeställningar analyseras utifrån ett kritiskt perspektiv på rätten. En radikalfeministisk teori har valts då centrala delar av den politiska diskussionen avser kvinnokroppen, makt och jämställdhet.

Baserat på de likheter som föreligger mellan prostitution och pornografi når uppsatsen slutsatsen att koppleribestämmelsen är möjlig att direkt tillämpa på pornografi sett till ordalydelsen. Däremot blir bestämmelsen om köp av sexuell tjänst inte tillämplig på företeelsen med hänsyn till närvaron av en kamera samt publiceringssyftet som föreligger vid produktion av pornografiska alster. Att ersättning utges till samtliga medverkande av en tredje part blir även det ett avgörande moment. Uppsatsen kommer vidare till slutsatsen att en kriminalisering av pornografi bör ske med utgångspunkt i de aktuella skyddsintressena vid prostitution samt radikalfeministisk teori. (Less)
Abstract
Prostitution and pornography are both regulated within the framework of Swedish criminal law. However, differences exist regarding which interests that are considered worthy of protection and to which extent a need for criminalization exists. Prostitution is currently criminalized in Sweden while pornography is not. The purpose of this essay is to gain a deeper understanding of which acts are to be considered a criminal exploit of the body, and which are not.

Prostitution and pornography are both regulated within the framework of Swedish criminal law. However, differences exist regarding which interests that are considered worthy of protection and to which extent a need for criminalization exists. Prostitution is currently criminalized in Sweden while pornography is not. The purpose of this essay is to gain a deeper understanding of which acts are to be considered a criminal exploit of the body, and which are not.

The essay examines and problematizes how the distinction between prostitution and pornography is made in the Swedish Penal Code. Subsequently, the possibilities to criminalize pornography are explored based on radical feminist theory and the protective interests that motivated criminalization of prostitution. These questions are analyzed from a critical perspective. A radical feminist theory has been chosen since central parts of the political discussion concern the female body, power and gender equality.

Based on the similarities that exist between prostitution and pornography the thesis concludes that the rule of procuring can be applied directly on pornography. However, the rule of purchase of sexual favors is not applicable to the current phenomenon because of the presence of a camera and the publication purpose that exists when producing pornography. Another crucial element is the fact that a third party provides compensation to the participating parties. The essay also concludes that pornography should be criminalized based on the protective interests that motivates criminalization of prostitution as well as radical feminist theory. (Less)
