Abstract (Swedish)
Uppsatsen syftar till att med stöd i den rättsdogmatiska metoden undersöka det straffrättsliga skyddet av barn som bevittnar våld mellan föräldrar, och vidare om skyddet kan anses vara förenligt med barnkonventionens krav. Vad gäller barnkonventionen fokuserar uppsatsen huvudsakligen på artikel 19, som ålägger staten att skydda barn mot alla former för psykiskt och fysiskt våld. Uppsatsen har också en komparativ del i form av en jämförelse med den norska rättsordningen. Norge har inkorporerat barnkonventionen i den norska lagen, och barn som bevittnar våld mellan närstående har dessutom erkänts status som brottsoffer. Sverige avser att inkorporera barnkonventionen i svensk lag år 2020.

Uppsatsen konstaterar att barnkonventionens bestämmelser inte respekteras i svensk rättstillämpning vad gäller barn som bevittnar våld mellan föräldrar. Detta eftersom de utsatta barnen inte ges erkännande som självständiga rättighetsbärare i rättstillämpningen, då de inte anses som målsäganden. Vidare hävdar uppsatsen att barns bevittnande av våld mellan föräldrar borde kunna utgöra ett ofredande av barnet, med motiveringen att det utgör en kännbar kränkning för ett barn att bevittna sin primära anknytningsperson utsättas för våld eller sexuella övergrepp. Om barn lever i ett hem där en förälder utsätts för upprepade och systematiska kränkningar av den andre föräldern argumenterar uppsatsen, med stöd i en jämförelse med den norska rätten, att detta kan utgöra en grov fridskränkning av barnet. Abstract
The purpose of this study is to analyze the judicial protection in the Swedish legal system of children who are exposed to domestic violence. Further, the aim is to discuss whether the criminal protection can be considered compatible with the requirements of the Convention on the Rights of the Child (CRC). Regarding the convention, the thesis mainly focuses on article 19, which states that the State Parties shall take all appropriate measures to protect the child from all forms of physical or mental violence. The purpose of this study is to analyze the judicial protection in the Swedish legal system of children who are exposed to domestic violence. Further, the aim is to discuss whether the criminal protection can be considered compatible with the requirements of the Convention on the Rights of the Child (CRC). Regarding the convention, the thesis mainly focuses on article 19, which states that the State Parties shall take all appropriate measures to protect the child from all forms of physical or mental violence. The study also consists of a comparison to the jurisprudence of children who are exposed to domestic violence in the Norwegian legal system. Norway has incorporated the Convention on the Rights of the Child, and children who are exposed to domestic violence have also been recognized as victims of a crime in the Norwegian legal system. Sweden intends to incorporate the CRC into Swedish law by 2020.

The study shows that the provisions of the CRC are not respected in the Swedish application of the law regarding children who are exposed to domestic violence. This conception is based on the fact that children who are exposed to domestic violence are not given the recognition as independent right holders. Thus, the vulnerable children are not considered as victims of a crime. Furthermore, the study argues that children who are exposed to domestic violence can be considered as victims of the crime molestation. Such an argument is based on the fact that it constitutes a perceptible offence for a child to witness a parent being subjected to violence or sexual abuse. Lastly, the study claims that if a child lives in a home where a parent is subjected to repeated and systematic violence from the other parent, this can constitute a gross violation of the integrity of the child.
