- Lagrådet har en central roll i att granska nya lagförslag från riksdagen och regeringen. Denna granskning går främst ut på att säkerställa så att lagarna är lättförståeliga och förenliga med redan rådande lagstiftning. Under senare tid har allt större vikt från Lagrådets sida lagts på att kontrollera att nya lagförslag inte inskränker enskildas grundlagsskyddade fri- och rättigheter samt att de står väl i samklang med överordnad Europeisk lagstiftning. Lagrådets laggranskande verksamhet har således alltmer kommit att likna någon slags normkontroll. Denna granskning går främst ut på att säkerställa så att lagarna är lättförståeliga och förenliga med redan rådande lagstiftning. Under senare tid har allt större vikt från Lagrådets sida lagts på att kontrollera att nya lagförslag inte inskränker enskildas grundlagsskyddade fri- och rättigheter samt att de står väl i samklang med överordnad Europeisk lagstiftning. Lagrådets laggranskande verksamhet har således alltmer kommit att likna någon slags normkontroll. Detta väcker frågan om dagens rättssituation bör föranleda ett beslut om att omvandla Lagrådet från en del av den lagstiftande organisationen i regering och riksdag till en självständig författningsdomstol. I föreliggande uppsats har jag valt att lägga fram historiskt förankrade argument som talar för att Lagrådet bör få ha kvar sin unika roll inom lagstiftningsprocessen. Jag föreslår även en administrativ utbyggnad av Lagrådet med revisionssekreterare liknande den som finns hos Högsta domstolen och Högsta förvaltningsdomstolen. Denna utvidgning tror jag skulle stärka Lagrådets oberoende ställning samtidigt som den skulle ge en mer effektiv laggranskningsprocess väl förankrad i folkviljan med möjlighet att ta nödvändig hänsyn till rättssäkerheten. - The Swedish Council on Legislation bears a central role in reviewing bills put forth by the Parliament to the government. The main objective of the review is to make sure that laws are both comprehensible and compatible with existing legislation. With time, a greater part of the Council on Legislation’s work has been devoted to ensuring that new bills conform to constitutional law. - The Swedish Council on Legislation bears a central role in reviewing bills put forth by the Parliament to the government. The main objective of the review is to make sure that laws are both comprehensible and compatible with existing legislation. With time, a greater part of the Council on Legislation’s work has been devoted to ensuring that new bills conform to constitutional law. There has also been an increased effort to harmonize new laws with the superior European legislation. As such, the role of the Council on Legislation has increasingly become one of standardization. Accordingly, a conversion of the present order with a Council on Legislation as a part of the legislative process into an independent constitutional court has been suggested. The aim of this paper is to argue that there are strong arguments rooted in history supporting the conservation of the present unique system of legislative review and against the conversion into an independent constitutional court. I instead propose an expansion of the present Council on Legislation to include judge referees as in the supreme and supreme administrative courts in Sweden. I believe this would strengthen its independence from government and parliament. It would also result in a more effective review of bills and ensure that legislation is in keeping with popular will with necessary legal consideration. (Less)
