Abstract
Domestic violence is a problem that affects people regardless of gender, age and descent. In total, about 5% of the population is affected annually. It is a problem that causes great suffering and has economic consequences for society as a whole. Historically, domestic violence has not been considered a problem in cases where it is exercised by a man in his own home. Over time it has come to be regarded as an expression of the lack of gender equality and a problem that society must take responsibility for.

Domestic violence is a problem that affects people regardless of gender, age and descent. In total, about 5% of the population is affected annually. It is a problem that causes great suffering and has economic consequences for society as a whole. Historically, domestic violence has not been considered a problem in cases where it is exercised by a man in his own home. Over time it has come to be regarded as an expression of the lack of gender equality and a problem that society must take responsibility for.

This report examines the legal protection against psychological domestic violence. To enable such an investigation, the concept of psychological violence, which lacks a legal definition, is discussed and exemplified. A number of classifications of a crimes are reviewed, along with their legislative history and practice. The violation of peace crimes are dealt with in depth, as these are, in part, designed to be applied to domestic violence.

The report concludes that there are several crimes that can enclose psychological violence, but that there are some practical obstacles to these being applied. An argument is made that the violation of peace crimes do not constitute adequate protection against psychological violence, they are not designed in a satisfactory manner and are, from a certain perspective, poorly adapted to reality. Protection against psychological violence should be expanded. (Less)

Våld i nära relationer är ett problem som drabbar människor oberoende av kön, ålder och härkomst. Totalt utsätts ca 5% av befolkningen årligen. Det är ett problem som orsakar stort lidande och har ekonomiska konsekvenser för samhället i stort. Historiskt sett har våldet inte ansetts utgöra något problem i de fall då det utövas av en man i sitt eget hem. Utvecklingen har gått mot att se det som ett uttryck för bristande jämställdhet och ett problem som samhället måste ta ansvar för.

Våld i nära relationer är ett problem som drabbar människor oberoende av kön, ålder och härkomst. Totalt utsätts ca 5% av befolkningen årligen. Det är ett problem som orsakar stort lidande och har ekonomiska konsekvenser för samhället i stort. Historiskt sett har våldet inte ansetts utgöra något problem i de fall då det utövas av en man i sitt eget hem. Utvecklingen har gått mot att se det som ett uttryck för bristande jämställdhet och ett problem som samhället måste ta ansvar för.

Denna framställning undersöker hur det juridiska skyddet mot psykiskt våld i nära relationer ser ut. För att möjliggöra en sådan undersökning diskuteras och exemplifieras begreppet psykiskt våld, som saknar en juridisk definition. Därefter följer en genomgång av en rad aktuella brottsrubriceringar, deras förarbeten och tillämpning. Fridskränkningsbrotten behandlas ingående, då dessa är utformade för att kunna tillämpas på våld i nära relationer.

Av slutsatsen framgår att det finns flera brottsrubriceringar som kan omfatta psykiskt våld, men att det finns vissa praktiska hinder mot att dessa ska kunna tillämpas. Fridskränkningsbrotten utgör inget fullgott skydd mot psykiskt våld i nära relationer då de är inte utformade på ett tillfredsställande sätt och är utifrån vissa perspektiv illa anpassade till verkligheten. Skyddet mot psykiskt våld bör utökas. (Less)
