Konkurrens i balans? - En granskning av konfliktlösningsregeln i 3 kap. 27 § konkurrenslagen

Abstract
In the field of competition law, there has been a discussion for decades about the distortions of competition that arise when public actors carry on economic activities in competition with private actors. These distortions derive from the different prerequisites that apply to public and private economic activity respectively. The prohibition rules in chapter 2 paras. 1 and 7 of the Competition Act (2008:579) can rarely set the distortions right, since these rules in principle are not concerned with the relation between public and private actors.

In the field of competition law, there has been a discussion for decades about the distortions of competition that arise when public actors carry on economic activities in competition with private actors. These distortions derive from the different prerequisites that apply to public and private economic activity respectively. The prohibition rules in chapter 2 paras. 1 and 7 of the Competition Act (2008:579) can rarely set the distortions right, since these rules in principle are not concerned with the relation between public and private actors.

In order to set the distortions right, new rules on anti-competitive public activities were passed and introduced in the Competition Act in 2010. Starting from research questions and focusing on municipalities, this essay investigates to what extent the main rule, the so-called conflict resolution rule, is appropriate. In the respects the rule is not appropriate, the essay further investigates what this be due to. Thus, it examines the purpose of the conflict resolution rule and its application since its coming into force. Then, it analyses the emerged shortages and their causes.

The essay establishes, that what throws a spanner into the works when applying the conflict resolution rule is mainly the court’s high evidentiary requirements. Due to the difficulties to meet these requirements, behaviours that are incompatible with the law can proceed. Furthermore, the court overlooks in several cases the essential differences between public and private economic activity that give the municipalities advantages over private actors.

Lastly, the essay also states that only three favourable judgments in cases of anti-competitive public activities have been passed since the coming into force of the rules. However, as a result of voluntary measures by public actors, the conflict resolution rule may have had a greater impact than what is shown in the court statistics. (Less)

Snedvridningarna kan härledas till de olika grundförutsättningar som gäller för offentlig respektive privat näringsverksamhet. Därefter analyseras de framkomna bristerna i tillämpningen och deras orsaker.

I uppsatsen fastställs att det som främst sätter käppar i hjulet vid tillämpningen av konfliktlösningsregeln är domstolens höga krav på bevisning. Svårigheterna att leva upp till dessa krav har visat sig innebära att beteenden, som trots att de inte är förenliga med lag, kan fortgå. Dessutom beaktar domstolen i flera fall inte de grundläggande skillnader mellan offentlig och privat näringsverksamhet som gör att kommunen, redan i sin egenskap av offentlig aktör, har fördelar framför privata aktörer.

Det konstateras även att endast tre förbud mot konkurrensbegränsande offentlig säljverksamhet meddelats sedan KOS-reglerna trädde ikraft. Till följd av frivilliga åtgärder från offentliga aktörer kan konfliktlösningsregeln emellertid ha fått större genomslag än vad domstolsstatistiken visar. (Less)
