När en klient vänder sig till en advokat för juridisk rådgivning är det viktigt att klienten kan förvänta sig goda råd som är baserade på noggranna undersökningar och korrekta bedömningar av rättsläget. Ibland leder dock advokatens råd eller agerande till skada för klienten. Ämnet är aktuellt i och med ett rättsfall från 2018 där Högsta domstolen ogillade en skadeståndstalan mot en advokat för att hans misstag inte visade på sådan brist på omsorg att det kunde medföra skadeståndsansvar. Ett annat avgörande från Högsta domstolen är att vänta senare i år där den ska ta ställning till om en advokat varit vårdslös i sin skatterådgivning och därmed skyldig att ersätta den uppkomna skadan. När en klient vänder sig till en advokat för juridisk rådgivning är det viktigt att klienten kan förvänta sig goda råd som är baserade på noggranna undersökningar och korrekta bedömningar av rättsläget. Ibland leder dock advokatens råd eller agerande till skada för klienten. Ämnet är aktuellt i och med ett rättsfall från 2018 där Högsta domstolen ogillade en skadeståndstalan mot en advokat för att hans misstag inte visade på sådan brist på omsorg att det kunde medföra skadeståndsansvar. Ett annat avgörande från Högsta domstolen är att vänta senare i år där den ska ta ställning till om en advokat varit vårdslös i sin skatterådgivning och därmed skyldig att ersätta den uppkomna skadan. Syftet med den här uppsatsen är att ta reda på hur advokatens rådgivningsskyldighet ser ut och vilka förutsättningar som krävs för skadeståndsansvar. Advokatens verksamhet är föga reglerat i lag. Skadeståndsansvaret bygger istället på allmänna kontrakts- och skadeståndsrättsliga principer och för branschen relevanta aktsamhetsnormer. För att skadeståndsskyldighet ska konstateras krävs att ett antal förutsättningar är uppfyllda. Advokaten ska ha förfarit vårdslöst enligt culparegeln, det ska för klienten ha uppkommit en ren förmögenhetsskada och mellan vårdslösheten och skadan ska föreligga adekvat kausalitet. Culpabedömningen utgår från plikter i Advokatsamfundets Vägledande regler om god advokatsed; resultatansvar, metodansvar och informationsansvar. I bedömningen tas även hänsyn till omständigheter i det enskilda fallet vilket gör utgången av ett skadeståndsmål oförutsebart. En advokat kan använda sig av reservationer och ansvarsbegränsningar för att begränsa sin skada. Det är viktigt att det finns en balans mellan advokatens ansvar och användningen av ansvarsbegränsningar för att upprätthålla förtroendet till klienten. (Less)

When a client turns to a lawyer for legal advice, it is important that the client can expect sound, reputable advice based on thorough investigations and correct legal judgments. Sometimes, however, the lawyer's advice or actions are harmful to the client. This topic is especially relevant in regard to a 2018 court case, where the Supreme Court dismissed a claim for damages against a lawyer because his mistake did not show such lack of care that it could lead to liability for damages. Another decision from the Supreme Court is expected later this year, where the court will decide whether a lawyer has been careless in his tax advice and will thereby be obliged to compensate for the damage that has arisen. When a client turns to a lawyer for legal advice, it is important that the client can expect sound, reputable advice based on thorough investigations and correct legal judgments. Sometimes, however, the lawyer's advice or actions are harmful to the client. This topic is especially relevant in regard to a 2018 court case, where the Supreme Court dismissed a claim for damages against a lawyer because his mistake did not show such lack of care that it could lead to liability for damages. Another decision from the Supreme Court is expected later this year, where the court will decide whether a lawyer has been careless in his tax advice and will thereby be obliged to compensate for the damage that has arisen. The purpose of this paper is to explore what a lawyer's counseling obligation looks like and what conditions are required for liability. A lawyer's activities are only partially regulated by law. Instead, liability for damages is based on general contractual and tort law principles and prudential standards within the industry. It is thus required that a number of conditions ought to be fulfilled in order to establish liability for damages. The lawyer must have acted carelessly according to the fault liability rule, he must have brought about a purely proprietary damage for the client and there must be adequate causality between the negligence and the injury. The assessment of negligence is based on duties in the Swedish Bar Association's guidelines on good lawyer practice; profit responsibility, method responsibility and information responsibility. The assessment also takes into account circumstances of the individual case, which makes the outcome of a claim for damages unpredictable. Lawyers are able to make use of reservations and limitations of liability to limit their damage. It is important that there is a balance between the lawyer's responsibilities and the use of limitation of liability in order to maintain trust of the client in their profession. (Less)
