- I denna uppsats undersöks om en abonnent kan aktualiseras för medhjälp när ett upphovsrättsintrång är identifierat på dennes internetanslutning.
Fildelning förekommer i stor utsträckning i samhället och det finns ingen tydlig vägledning om medhjälp kan aktualiseras för en enskild abonnent. Det är därför av betydelse att undersöka denna fråga.
Uppsatsen förklarar upphovsrätten och det straffrättsliga ansvaret medhjälp och sammanfattningen av de avslutande reflektionerna är att det finns en möjlighet till att enskild abonnent kan hållas ansvarig för medhjälp om denne med aktivt handlande tillhandahåller sin internetanslutning till annan, har kännedom om att olagliga intrång sker på dennes internetanslutning och väljer att inte agera. Uppsatsen förklarar upphovsrätten och det straffrättsliga ansvaret medhjälp och sammanfattningen av de avslutande reflektionerna är att det finns en möjlighet till att enskild abonnent kan hållas ansvarig för medhjälp om denne med aktivt handlande tillhandahåller sin internetanslutning till annan, har kännedom om att olagliga intrång sker på dennes internetanslutning och väljer att inte agera. I något annat fall anses det att utvidga medhjälpsansvaret vilket är problematiskt med anledning av legalitetsprincipen och rättssäkerheten. (Less) - Abstract
- This essay analyze if a subscriber of an Internet connection can be sentenced for complicity when a copyright infringement is identified on the subscribers internet connection. Filesharing occurs in a larg extent in the society and there is no clear supervision in the matter. It is therefore a great significant to investigate this question.
The essay explains the copyright and the criminal responsibility for complicity and the summary is that there is a possibility for an individual subscriber to be held accounted for complicity, if that individual active provided his internet connection to another, and had knowledge about the illegal infringements on the his internet connection, and he chooses not to act.
