Tölpaktigt beteende eller kriminaliserad handling? - en utredning av brottet sexuellt ofredande

Abstract (Swedish)
Syftet med denna uppsats är att utreda det faktiska omfånget av BrB 6 kap. 10 § andra stycket vilket föreskriver straffansvar för sexuellt ofredande. Den som genom ord eller handling ofredar annan på ett sätt som kan anses ägnat att kränka den utsattes sexuella integritet träffas av bestämmelsen. Brottet sexuellt ofredande är subsidiärt till övriga sexualbrott och väcker många gränsdragningsfrågor vilka har utreds i denna uppsats.
Genom en historisk tillbakablick tillsammans med studier av vägledande avgöranden från högsta domstolen syftar framställningen till att slutligen sammanställa en övergripande analys av brottet i fråga, för att sedan diskutera detta ur ett genusrättsvetenskapligt perspektiv.

Den som genom ord eller handling ofredar annan på ett sätt som kan anses ägnat att kränka den utsattes sexuella integritet träffas av bestämmelsen. Brottet sexuellt ofredande är subsidiärt till övriga sexualbrott och väcker många gränsdragningsfrågor vilka har utreds i denna uppsats.
Genom en historisk tillbakablick tillsammans med studier av vägledande avgöranden från högsta domstolen syftar framställningen till att slutligen sammanställa en övergripande analys av brottet i fråga, för att sedan diskutera detta ur ett genusrättsvetenskapligt perspektiv.
Slutsatserna är att det finns en reell gränsdragningsproblematik förknippad med brottet sexuellt ofredande och i synnerhet andra ledet i straffbestämmelsens sista stycke. Denna problematik hänför sig dels till en avsaknad av uttrycklig kriminalisering av handlingar som inte vidtas på det rent fysiska planet, det vill säga till exempel verbala handlingar. Även handlingar som är fysiska tenderar att inte falla inom det straffbara området om gärningspersonen i det enskilda fallet inte givit uttryck för en vilja att tillfredsställa sin sexuella drift.
Då sexuellt ofredande är ett brott som huvudsakligen drabbar kvinnor, är det även kvinnor som riskerar att lida av en otydlig och mångtydig rättstillämpning. Det fokus som läggs på subjektiva förhållanden hos gärningspersonen hade lika gärna kunnat ligga på den kränkning som offret upplever, om bedömningen trots allt ska tillåtas ha den indirekta subjektiva karaktär den idag kan anses ha. Abstract
The purpose of this thesis is to investigate the scope of the 6th chapter, 10th paragraph of the Swedish Penal Code, which prescribes criminal liability for sexual abuse. Anyone who through word or deed abuses another person in a way that can be considered to be violating of the sexual integrity of the victim is performing a criminalized act. The offense of sexual abuse is subsidiary to other sexual offenses and raises many boundary issues which are investigated in this essay.
Through a historical look accompanied by studies of guiding decisions from the Swedish Supreme Court, the thesis aims to compile an overall analysis of the crime in question, as well as a discussion from a gender-legal perspective.

The purpose of this thesis is to investigate the scope of the 6th chapter, 10th paragraph of the Swedish Penal Code, which prescribes criminal liability for sexual abuse. Anyone who through word or deed abuses another person in a way that can be considered to be violating of the sexual integrity of the victim is performing a criminalized act. The offense of sexual abuse is subsidiary to other sexual offenses and raises many boundary issues which are investigated in this essay.
Through a historical look accompanied by studies of guiding decisions from the Swedish Supreme Court, the thesis aims to compile an overall analysis of the crime in question, as well as a discussion from a gender-legal perspective.
The conclusion is that there is a real demarcation problem associated with the crime of sexual harassment and, in particular, the second part of the last paragraph of the penal provision in question. This problem is partly due to the lack of explicit criminalization of acts that are not on the purely physical spectrum, for instance verbal acts. Even acts that are physical tend not to fall within the criminalized area if the perpetrator in the specific case has not in some way clearly expressed a desire to satisfy his sexual drive.
Since sexual abuse is a crime that mainly affects women, it is also women as a group who risk suffering from an unclear and ambiguous application of law. The focus placed on the subjective intentions of the perpetrator could just as well have been placed on how the violation is perceived by the victim, if the legal system is going to allow this indirectly subjective assessment that is being carried out in courts today.
