Begreppet asylrätt definieras sällan trots att det används i flera rättighetsinstrument samt i nationella rättsordningar. Asylrätt positioneras ofta som en mänsklig rättighet men innebär ingen direkt rätt till skydd för individen utan anses istället vara en rättighet tillhörande staten. Som påvisas i det här arbetet finns det inte heller någon indirekt rätt till skydd, eftersom de skyddsmekanismer som finns i den internationella rätten ständigt urholkas av staters åtgärder för att hindra individers tillgång till asyl. Ur ett individperspektiv leder detta till negativa konsekvenser, och påkallar att rättsläget förändras så att individens skydd i den internationella rätten stärks.
Abstract
The terms right to and right of asylum are not synonymous but are used to describe the same kind of right in international, regional and national regulations. Though the concept of asylum is often positioned as a human right it is not actually conceived to be a right pertaining to the individual but rather to the state. As this essay will show the concept of asylum does not result in a direct or indirect right to protection, as the protective mechanism available in international law is constantly undermined by state practice to obstruct access to asylum. This leads to negative outcomes for the individual, and calls for a change to better protect the individual in international law.
