- Abstract
- The terms right to and right of asylum are not synonymous but are used to describe the same kind of right in international, regional and national regulations. Though the concept of asylum is often positioned as a human right it is not actually conceived to be a right pertaining to the individual but rather to the state. As this essay will show the concept of asylum does not result in a direct or indirect right to protection, as the protective mechanism available in international law is constantly undermined by state practice to obstruct access to asylum. This leads to negative outcomes for the individual, and calls for a change to better protect the individual in international law.
