Barnets bästa i samband med umgängessabotage

Abstract
The purpose of this thesis is to investigate visitation interference in relation to the child’s best interests. The topic is relevant as the number of custody disputes in Sweden has increased. In addition, there is a need to investigate the question because children are more widely regarded as individuals with their own rights and interests. Such development can be seen from the change in FB in 2006 and the incorporation of the UN Convention on the Rights of the Child.

The purpose of this thesis is to investigate visitation interference in relation to the child’s best interests. The topic is relevant as the number of custody disputes in Sweden has increased. In addition, there is a need to investigate the question because children are more widely regarded as individuals with their own rights and interests. Such development can be seen from the change in FB in 2006 and the incorporation of the UN Convention on the Rights of the Child.

According to 6 kap. 2 a § FB, the child’s best interest shall be decisive for all decisions on custody, housing and access. The paragraph mentions certain factors that should be considered in particular, for example the child's will, the risk that the child will get hurt and the child's need for close and good contact with both parents. The principle of the best interests of the child is also one of the foundations of the UN Convention on the Rights of the Child.

Disputes relating to visitation interference often result in a trade-off between the child's need for continuity and the child's need for close and good contact with both parents. There are examples in court practice both when custody is kept and when it is transferred. Thus none of the criteria is automatically given preference.

The formulation of the principle of the best interests of the child has been criticised in doctrine. For example, that it must be further concretized, that it is seen through the adult decision maker's eyes and that the strict legal definition makes it difficult to help children in practice. This is a fine balance: clearer criteria give greater legal certainty and predictability. However, it reduces the court's ability to be flexible based on the circumstances of the individual case.

An assessment of the child's best interests should be done in each individual case according to the legislative history of FB. Thus, it is not possible to say how visitation interference should be assessed in general. I believe that it is not compatible with the child’s best interests that the criteria are further concretized or ranked in relation to each other as it makes the court tied in its interpretation. Syftet med denna uppsats är att utreda umgängessabotage i relation till barnets bästa. Ämnet är aktuellt då antalet vårdnadstvister ökar. Dessutom finns det behov av att utreda frågan då barn i större utsträckning ses som individer med egna rättigheter och intressen. En sådan utveckling kan ses utifrån ändringen i FB år 2006 samt inkorporeringen av barnkonventionen.

Tvister som rör umgängessabotage utmynnar ofta i en avvägning mellan barnets behov av kontinuitet och barnets behov av en nära och god kontakt med båda föräldrarna. Det finns exempel i praxis både på när vårdnaden behållits och när den flyttats över. Det är således ingen av kriterierna som automatiskt ges företräde.

Principen om barnets bästa har kritiserats i doktrin. Till exempel har framförts att den måste konkretiseras ännu mer, att den ses genom den vuxna beslutsfattarens ögon och att den strikta juridiska definitionen gör det svårt att hjälpa barn i praktiken. Här får en avvägning ske: tydligare kriterier ger större rättssäkerhet och förutsebarhet. Dock minskar det domstolens möjligheter att vara flexibel utifrån omständigheterna i det enskilda fallet.

Enligt förarbetena ska en bedömning av vad som är barnets bästa göras i varje enskilt fall. Således går inte att säga hur umgängessabotage ska bedömas allmänt. Jag anser att det inte är förenligt med barnets bästa att kriterierna ytterligare konkretiseras eller rangordnas i förhållande till varandra då det gör domstolen bunden i sin tolkning. (Less)
