- Hemliga tvångsmedel är av stor betydelse för framgångsrik brottsbekämpning i samhället. Samtidigt innebär det en inskränkning av den enskildes rätt till privat- och familjeliv.
Detta arbete analyserar om det är möjligt för brottsbekämpande myndigheter att skapa trygghet i den demokratiska rättsstaten genom mer effektiv brottsuppklaring med hjälp av hemliga tvångsmedel, utan att samtidigt kränka den enskildes integritet, och om nyttan står i proportion till kostnaderna för individen och samhället. Detta arbete analyserar om det är möjligt för brottsbekämpande myndigheter att skapa trygghet i den demokratiska rättsstaten genom mer effektiv brottsuppklaring med hjälp av hemliga tvångsmedel, utan att samtidigt kränka den enskildes integritet, och om nyttan står i proportion till kostnaderna för individen och samhället. De hemliga tvångsmedlen, såsom hemlig avlyssning av elektronisk kommunikation (HAK), hemlig övervakning av elektronisk kommunikation (HÖK), hemlig kameraövervakning (HKÖ) samt hemlig rumsavlyssning (HRA) används främst vid riktigt grov brottslighet och påverkar i största mån de som rör sig i kriminella kretsar. Den laglydige medborgaren löper inte en hög risk att utsättas för integritetskränkningar i samband med hemliga tvångsmedel. Efter noggrann granskning av statistik och tillämpningen av lagreglerna kan det sammanfattningsvis bedömas att brukandet av hemliga tvångsmedel är nödvändigt för effektiv brottsbekämpning, och enskilda i samhället får acceptera ett visst intrång i privatlivet för att åtnjuta den trygghet det innebär. Även om statistiken visar på relativt låga siffror vad gäller förbättrade möjligheter till brottsbekämpning, kan inskränkningen anses stå i proportion till nyttan. Det finns flera nya lagförslag på åtgärder avsedda att effektivisera användningen av hemliga tvångsmedel samt att göra regelverket mer förenligt med unionsrätten. Flera av dem förväntas träda i kraft den 1 juli 2019. Trots att det finns utrymme för vidare utveckling så kan användningen av hemliga tvångsmedel i dagsläget anses förhållandevis rättssäkert. - Secret surveillance methods are of great importance for successful law enforcement in today’s society, however, the benefits for the crime fighting authorities can be at the expense of the individual’s rights to privacy.
The object of this thesis is to analyze whether it is possible for law enforcement agencies to create a safe community, in a democratic constitutional state, through the use of secret surveillance methods, without violating the integrity of the individual citizen.
Do the societal benefits of secret surveillance out-weigh the costs to the individual and the community?
The secret surveillance methods, such as wire tapping, bugging, data collection/interception, secret camera surveillance, and cell phone location tracking... The object of this thesis is to analyze whether it is possible for law enforcement agencies to create a safe community, in a democratic constitutional state, through the use of secret surveillance methods, without violating the integrity of the individual citizen.
Do the societal benefits of secret surveillance out-weigh the costs to the individual and the community?
The secret surveillance methods, such as wire tapping, bugging, data collection/interception, secret camera surveillance, and cell phone location tracking through cell phone towers, are mainly used to investigate very serious crimes. The law-abiding citizen does not run a high risk of being subjected to violations of integrity in connection with these secret surveillance methods.
After careful research and scrutiny of statistics and the application of the law rules, it can be concluded that the use of secret surveillance methods is necessary for effective law enforcement. The citizen may have to accept a certain level of intrusion into their privacy to enjoy the security the methods provide for the community. Although the statistics show relatively low figures regarding improved opportunities for law enforcement, the restriction to the citizen can be considered proportionate to the benefit. There are several new legislative proposals for ways of making the use of secret surveillance methods more efficient, and changing the current legislation to make it more compatible with Union law. Several of the new proposals are expected to enter into force on 1 July 2019. Despite the fact that there is still room for improvement, the use of secret surveillance methods can be considered relatively safe, legally. (Less)
