- Upphovsrätten präglas av flera svåra gränsdragningar varav denna uppsats fördjupar sig inom en av dessa. Svårigheten som behandlas i detta sammanhang består av problematiken att avgöra var gränsen går mellan ett skyddat verk och en oskyddad idé. Vissa aspekter inom området är tydliga, i form av att enbart en idé inte kan åtnjuta upphovsrättsligt skydd medan en färdig produkt har möjlighet till skydd, om vissa grundläggande krav uppnås. Dock gör det att det uppkommer en svårbedömlig ”gråzon” där emellan. Syftet med uppsatsen har således varit att undersöka i vilken utsträckning idéer och koncept kan skyddas genom upphovsrätt enligt EU-rätten respektive amerikansk rätt samt att jämföra dessa rättssystem.

Inledningsvis undersöks vad som utgör ett upphovsrättsligt skyddat verk enligt EU-rätt och amerikansk rätt. Frågan är väsentlig eftersom det är nödvändigt att först fastställa vad som kan skyddas av upphovsrätt för att kunna klargöra om och i vilken utsträckning idéer och koncept kan skyddas inom de två jurisdiktionerna. Därefter görs en jämförelse mellan EU-rätten och amerikansk rätt med fokus på aspekterna av det upphovsrättsliga skyddet. Undersökningen konstaterar att rättsläget i vissa delar är oklart i de två rättssystemen samt att en tydlig jämförelse inte kan åstadkommas i dagens oklara rättsläge. (Less) - Abstract

The difficulty in this context consists of the problem of determining where the boundaries, in which a work can be qualified for copyright protection, lies between a protected work and an unprotected idea. Thereafter a comparison between the legal systems takes place.
The thesis begins by examining what can constitute as a copyright protected work according to both the EU- and the US law. This issue is an essential part of investigation due to the fact that in order to clarify to what extent ideas and concepts can be protected within the two legal systems, it must first be determined what can be protected. Thereafter the comparison between EU law and US law regarding the protection of these aspects takes place. In conclusion, the thesis concludes that the legal situation is unclear in some parts of the two legal systems, and that a clear comparison cannot be achieved during today’s unclear legal situation.
