Abstract
This study aims to clarify the conditions for swedish municipalities to handle returnees from radical islamic environments. This has been done through a study of the legal conditions, a literature review focused on programs and methods combined with qualitative interviews with representatives from two municipalities. A theoretical framework that describes a norm- forming process and an analytical structure that accommodates the dimension of law and society as well as the dimension of is and ought has been used to comprehend the phenomenon from a socio-legal perspective. This study aims to clarify the conditions for swedish municipalities to handle returnees from radical islamic environments. This has been done through a study of the legal conditions, a literature review focused on programs and methods combined with qualitative interviews with representatives from two municipalities. A theoretical framework that describes a norm- forming process and an analytical structure that accommodates the dimension of law and society as well as the dimension of is and ought has been used to comprehend the phenomenon from a socio-legal perspective. The state governance is mainly exerted through the formal law, the Social Service Act occupies a central position as primary law. Secondary law constitutes of public secrecy legislation and constitutional rights legislation which to some extent becomes relevant. As the Social Service Act is a framework law, it merely expresses basic principles and goals. The municipality will in turn apply the law and design initiatives based on available resources and norms. When the research foundation is scarce, a great deal of responsibility falls on the social welfare officers who to the best of their ability can assess individual needs and appropriate efforts. The indications that current research still provides can be seen to varying degrees in the municipal work. In conclusion: A weak state governance in combination with lack of evidence-based methods to apply constitutes an arduous municipal situation. (Less)
