Today, the public of society is considered to obsess of the topic of crime which daily news frequently distributes to the public by proclaiming shockingly headline regarding criminals and deviance. All tough, it seems to be an asymmetry between the public perception of crime and the characteristics of suspects versus the court's judgment of crime and the characteristics of suspects. This asymmetry can lead to a reduction in public confidence in the law, which is why it appears to be substantially to gain an understanding regarding the complex relationship between the media and the court. The aim of this study, therefore, has been to analyze a specific legal case in the media and the court, by examining the construction of the ideal offender and the discrepancy that exists between these two constructions. Another aim has been to examine how these constructions meditate through communication. These aims are deemed to illustrate the structure of power in today’s society. By using a critical discourse analysis with the tool modality and the theoretical framework of Nils Christies, the ideal offender & Jürgen Habermas theory of communicative action, the study showed that constructions of the offender differed between the media and the court in various factors. In overall, the media manages to construct a picture of the suspects so that they become more incorporated as ideal perpetrators than what the court does. Both the media and the court construct the suspects in a way that upholds the power structure in society. (Less)
