The purpose of this essay was to examine the amendment to the law (1960:729) on copyright for literary and artistic works as of SFS 2018:1099. The purpose was also to examine whether this amendment has taken into sufficient consideration the international principles for the protection of human rights for people with disabilities, or if the alteration has been of a mostly symbolic nature. According to a report from the World Health Organization, restricted access to information and culture cause severe hardships. Above all, this applies to difficulties with taking an active part in society, as well as difficulties with self-realisation and fulfilment while lacking proper access to culture and literature. Such difficulties are in conflict with the principle of equality before the law, according to which every person has a right to the same protection by the law, without discrimination and against discrimination — including the actual means to exercise ones rights on the same terms as everyone else. Accordingly, aside from a theoretical protection, the principle must be realised, so that the effect and the rights are the same for all people in practice.

In this essay I have studied relevant articles and paragraphs within national and international legislation, to find the international legal principles relating to equality before the law and to those rights for persons with disabilities. The purpose was also to track the course of these principles throughout the levels of legislation, all the way from the Universal Declaration of Human Rights to the above-mentioned national amendment, meant to realise the values expressed in these principles. In this examination I have found six principles to stand out, which together form a foundation for protecting and realising the human rights. I have also been able to confirm that these principles remain in the national amendment, which in combination with previous legislation make up an even stronger protection for persons with disabilities than the EU requires of its member countries. Consequently I have been able to establish that the national amendment has taken into sufficient consideration the protection of the principle of equality before the law, in both theory and practice. Denna uppsats hade som syfte att undersöka lagändringen av lagen (1960:729) om upphovsrätt till litterära och konstnärliga verk i och med SFS 2018:1099. Syftet var också att utforska om denna på ett tillfredsställande sätt tagit hänsyn till de folkrättsliga principerna om skydd för mänskliga rättigheter för personer med funktionsvariationer, eller om ändringen till största del varit symbolisk. Denna uppsats hade som syfte att undersöka lagändringen av lagen (1960:729) om upphovsrätt till litterära och konstnärliga verk i och med SFS 2018:1099. Syftet var också att utforska om denna på ett tillfredsställande sätt tagit hänsyn till de folkrättsliga principerna om skydd för mänskliga rättigheter för personer med funktionsvariationer, eller om ändringen till största del varit symbolisk. Lagändringen byggde på EU:s anslutande till Marrakechfördraget om att underlätta tillgången till publicerade verk för personer med blindhet, synnedsättning, eller annan läsnedsättning, samt därpå följande EU-lagstiftning — bland annat direktiv 2017:1564 om viss tillåten användning av vissa verk och andra alster som skyddas av upphovsrätt och närstående rättigheter till förmån för personer med blindhet, synnedsättning eller annan läsnedsättning […].

Enligt en rapport framställd av World Health Organization orsakar begränsad tillgång till information och kultur många svårigheter. Detta gäller framför allt svårigheter i att aktivt ta del av samhället utan tillgänglig information, samt svårigheter till självförverkligande utan tillgång till kultur och litteratur. Sådana svårigheter står i konflikt med principen om likhet inför lagen, som förespråkar alla människors rätt till samma skydd av lagen utan diskriminering och mot diskriminering — inklusive möjligheten att ta del av sina rättigheter på samma villkor som andra. Detta måste alltså utöver att skyddas i teorin även förverkligas i praktiken så effekten och rättigheterna i praktiken blir samma för alla människor.

I undersökningen har jag studerat relevanta artiklar och paragrafer på nationell och internationell nivå. Detta har gjorts för för att utröna vilka allmänna folkrättsliga principer som relaterar till likhet inför lagen och till dessa rättigheter för personer med funktionsnedsättningar. Det har också gjorts för att om möjligt följa principernas väg genom alla steg av normbildning från FN:s allmänna förklaring om mänskliga rättigheter ända till den aktuella lagändringen, som är tänkt att förverkliga de värden som dessa principer uttrycker. I denna undersökning har jag upptäckt sex stycken principer som i samspel utgör grunden för att de mänskliga rättigheterna som studerats ska skyddas och förverkligas. Jag har också kunnat bekräfta att dessa principer finns kvar även i den svenska lagändringen, som tillsammans med tidigare lagstiftning utgör ett starkare skydd för personer med funktionsnedsättning än vad som krävs av EU. Därmed har jag kunnat konstatera att lagändringen tagit tillräcklig hänsyn till att principen om likhet inför lagen ska skyddas, både i teori och i praktik. (Less)
