Om åtalsunderlåtelse för unga lagöverträdare – en utredning med fokus på åklagares diskretionära utrymme i modern rättsutveckling

Sedan efterkrigstiden har det skett en markant ökning av antalet anmälda brott. Detta har inneburit att arbetsbelastningen på de rättsvårdande myndigheterna ökat. En konsekvens av utvecklingen är att lagstiftaren försökt effektivisera processen samt hitta andra sätt att avgöra ansvarsfrågan på. Som följd av detta har bland annat åtalsunderlåtelseinstitutet fått en etablerad plats inom svensk straffprocessrätt. Det finns också forskning på hur de allmänna reglerna har utvecklats sedan efterkrigstiden. Hur de särskilda reglerna som gäller för unga lagöverträdare har utvecklats under samma period, är däremot ett mer outforskat område.

En konsekvens av utvecklingen är att lagstiftaren försökt effektivisera processen samt hitta andra sätt att avgöra ansvarsfrågan på. Som följd av detta har bland annat åtalsunderlåtelseinstitutet fått en etablerad plats inom svensk straffprocessrätt. Det finns också forskning på hur de allmänna reglerna har utvecklats sedan efterkrigstiden. Hur de särskilda reglerna som gäller för unga lagöverträdare har utvecklats under samma period, är däremot ett mer outforskat område.

Avsikten med denna uppsats har varit att analysera hur den moderna rättsutvecklingen sett ut, beträffande den lagstiftade möjligheten för åklagare att kunna besluta om åtalsunderlåtelse för unga lagöverträdare mellan 15 och 17 år. En del av syftet har vidare varit att utreda hur åklagarnas diskretionära utrymme sett ut under perioden år 1965–2018. Vid denna utredning har avsikten varit att belysa det eventuella hänsynstagandet som gjorts till rättssäkerhet och/eller brottsbekämpning. Valet att undersöka hänsynstagandet som gjorts till rättssäkerhet och brottsbekämpning, beror i sin tur på att straffprocessens funktion ofta beskrivs som dessa.

Den följande utredningen har visat att utrymmet att besluta om åtalsunderlåtelse sammantaget har genomgått en utvidgning och detsamma gäller vad beträffar åklagarnas diskretionära utrymme. Vid ändringarna som gjorts har hänsyn framför allt tagits till brottsbekämpning. Vissa skillnader finns dock mellan utvecklingen av de allmänna reglerna respektive de särskilda reglerna som gäller för unga lagöverträdare. Medan de allmänna reglerna primärt har motiverats av viljan att främja effektivitet, har reglerna för unga lagöverträdare i större omfattning motiverats med skäl av en mer individualpreventiv karaktär. Hänsynstaganden till rättssäkerhet har vidare gjorts i mindre utsträckning än hänsynstaganden till brottsbekämpning. (Less)

Since the post-war era, there has been a significant increase in the number of crimes being reported. This has led to increased workloads for law enforcement authorities. As a direct consequence of this development, legislators have sought to streamline processes and to find alternative means of issuing determinations on matters of guilt and responsibility. As a result, the institute of abstention from prosecution has established itself in Swedish criminal law. Whilst research exists to demonstrate and outline how the general rules have evolved since the post-war era, little research exists to show how the special rules that apply to young offenders have evolved.

Since the post-war era, there has been a significant increase in the number of crimes being reported. This has led to increased workloads for law enforcement authorities. As a direct consequence of this development, legislators have sought to streamline processes and to find alternative means of issuing determinations on matters of guilt and responsibility. As a result, the institute of abstention from prosecution has established itself in Swedish criminal law. Whilst research exists to demonstrate and outline how the general rules have evolved since the post-war era, little research exists to show how the special rules that apply to young offenders have evolved.

The purpose of this essay has been to analyze developments within the contemporary legal system with regards to the ability afforded to prosecutors to refrain from prosecuting young offenders between the ages of 15 and 17 years of age. As part of this essay, an investigation has been undertaken into the topic of the evolution of the designated discretionary powers invested in prosecutors between the years of 1965 and 2018. The purpose of the investigation has been to examine and highlight considerations given to judicial safety and/or law enforcement efficiency. The decision to examine these aspects in particular, has been due to the fact that the function of the criminal process is often described as either judicial safety and/or law enforcement.

This investigation has shown an increase in the scope of authority for making decisions in regards to refusals to prosecute young offenders, as well as an expansion of the designated discretionary powers afforded to prosecutors. With these changes, consideration has been given to law enforcement efficiency. However, there are distinguishing features present in regards to the development of the general rules versus the special rules that applies to young offenders. Whilst the general rules have been developed to promote efficiency, the rules for young offenders have primarily derived from a desire to promote individual prevention. The considerations given to the topic of judicial safety have furthermore been lesser than the considerations given to law enforcement. (Less)
