En advokat bär på kontraktsrättslig grund ett ansvar gentemot sin klient. Om advokaten vållar sin klient skada genom oaktsamhet ska denne ersätta klienten för skadan. Det finns inte någon särskild lag som klargör skadeståndsansvaret för advokater men på bara de senaste två åren har Högsta Domstolen prövat två mål som handlar om advokaters skadeståndsansvar gentemot sina klienter.

Förutsättningarna för skadestånd är indelade i två delar, de objektiva och de subjektiva. De objektiva förutsättningarna är att skada ska ha uppstått och att adekvat kausalitet föreligger mellan den skadebringande handlingen och skadan. Det finns inte någon särskild lag som klargör skadeståndsansvaret för advokater men på bara de senaste två åren har Högsta Domstolen prövat två mål som handlar om advokaters skadeståndsansvar gentemot sina klienter.

Förutsättningarna för skadestånd är indelade i två delar, de objektiva och de subjektiva. De objektiva förutsättningarna är att skada ska ha uppstått och att adekvat kausalitet föreligger mellan den skadebringande handlingen och skadan. Därutöver krävs det att advokaten har varit vårdslös i sitt agerande. I denna bedömningen måste först en handlingsnorm identifieras för att därefter kunna fastställa om normen har åsidosatts till den grad att handlandet måste betraktas som vårdslöst.

Den subjektiva ansvarsförutsättningen grundar sig främst i professionsansvaret och den särskilda kunskap som en advokat förutsätts ha i sin egenskap av juridisk expert och ledamot av advokatsamfundet. Det innebär inte att en advokat måste känna till all juridik. Däremot förutsätts det att advokaten utför sitt uppdrag på sådant sätt att metoden uppfyller de krav som kan förväntas av en advokat, dvs utreder relevanta rättskällor för att leverera ett så bra resultat som möjligt till klienten

En advokat bär gentemot sin klient flera olika skyldigheter som inte explicit framgår av lagtexten, men som genom advokatsamfundets riktlinjer, domstolsavgöranden samt doktrin anses utgöra grund för aktsamhetsbedömnigen. Frågan är om det behövs en särskild lag som reglerar advokatens skadeståndsansvar, eller om rättsläget som det ser ut idag är tillfredställande. (Less)
Abstract
A lawyer is, under contract law, liable to his client for any damage caused as a result of careless consulting. If the lawyer causes his client harm through negligence, he must compensate the client for the damage. There is no specific Swedish law that clarifies liability for lawyers, but in the last two years, the Supreme Court has tried two cases that deal with lawyers' liability towards their clients.

The prerequisites for lawyers´ liability are divided into two parts, the objective and the subjective. The objective assumptions are that the client must have been afflicted by damage and there must also be a proximate cause between the negligence and the damage that has occurred. A lawyer is, under contract law, liable to his client for any damage caused as a result of careless consulting. If the lawyer causes his client harm through negligence, he must compensate the client for the damage. There is no specific Swedish law that clarifies liability for lawyers, but in the last two years, the Supreme Court has tried two cases that deal with lawyers' liability towards their clients.

The prerequisites for lawyers´ liability are divided into two parts, the objective and the subjective. The objective assumptions are that the client must have been afflicted by damage and there must also be a proximate cause between the negligence and the damage that has occurred. In addition, it is required that the lawyer has been careless in his actions. In this assessment, a standard of action must first be identified to then be able to determine whether the norm has been breached to the extent that the conduct must be considered careless.

The subjective assumption of responsibility is mainly based on professional responsibility and the special knowledge that a lawyer is required to have in his capacity as a legal expert and member of the legal community. This does not mean that a lawyer must know all the laws, but that he has to make sufficient studies of the sources of law that can be expected of a lawyer to reach the best result for the client.

A lawyer has a number of obligations to his client that are not explicitly stated in the law, but which, through the bar association guidelines, judicial decisions and the doctrine, are considered as basis for negligence assessment. The question is whether a special law is needed that governs the lawyer's liability, or if the legal situation as it seems today is sufficient. (Less)
