Den här uppsatsen handlar om tillämpningen av barnets bästa i vårdnadstvister som föregåtts av umgängessabotage. När vårdnaden om ett barn ska beslutas ska avgörandet göras efter vad som är barnets bästa. Umgängessabotage utgör en omständighet av särskild betydelse i avvägningen mellan olika intressen som alla kan tala för barnets bästa. Därtill är ett barns bästa inte alltid det bästa för ett annat barn, varför bedömningen måste göras i varje enskilt fall efter individuella omständigheter.

Den här uppsatsen handlar om tillämpningen av barnets bästa i vårdnadstvister som föregåtts av umgängessabotage. När vårdnaden om ett barn ska beslutas ska avgörandet göras efter vad som är barnets bästa. Umgängessabotage utgör en omständighet av särskild betydelse i avvägningen mellan olika intressen som alla kan tala för barnets bästa. Därtill är ett barns bästa inte alltid det bästa för ett annat barn, varför bedömningen måste göras i varje enskilt fall efter individuella omständigheter.

Uppsatsen inleds med att ge en grundläggande rättslig förståelse för ämnets relevanta områden. Det innefattar den rättsliga regleringen och rättskällornas fördjupning av vårdnad, umgänge, umgängessabotage, principen om barnets bästa samt kontinuitetsprincipen. Umgängessabotage föreligger när en förälder motverkar eller försvårar umgänget mellan ett gemensamt barn och den andra föräldern. Enligt såväl Högsta domstolen som förarbeten bör vårdnaden om ett barn först och främst anförtros den förälder som bäst kan främja ett tillfredsställande umgänge, om inte andra omständigheter talar emot. Omständigheter som kan tala emot är i huvudsak barnets vilja, risken för att barnet far illa eller kontinuitetsprincipen, vilka alla är viktiga beståndsdelar i bedömningen av barnets bästa.

Den andra delen av uppsatsen består av en djupgående redogörelse för innehållet i sex vårdnadsmål från 2019 som föregåtts av umgängessabotage. Domarna analyseras i ljuset av vad som framkommit om tillämpningen av barnets bästa i förarbeten, praxis och doktrin. Inget mönster för hur utfallet av domen blir i förhållande till omfattningen av umgängessabotage återfinns i analysen av domarna. Däremot ger analysen vid handen att domstolarna nästintill alltid behandlar följande punkter: respektive förälders lämplighet som vårdnadshavare, barnets vilja samt kontinuitetsprincipen. (Less)
Abstract
The purpose of this paper is to examine the adjudication of the child's best interest in custody trials preceded by one parent preventing the other parent from contact with the child. In custody trials, the best interest of the child is always the primary consideration. Preventing the other parent from contact with the child constitute a circumstance of particular importance in the determination of what the child's best interest is. In addition, one child's best interest does not speak for every child's best interest and the assessment of the child's best interest must therefore be individual and based on the specific circumstances of the case.

The purpose of this paper is to examine the adjudication of the child's best interest in custody trials preceded by one parent preventing the other parent from contact with the child. In custody trials, the best interest of the child is always the primary consideration. Preventing the other parent from contact with the child constitute a circumstance of particular importance in the determination of what the child's best interest is. In addition, one child's best interest does not speak for every child's best interest and the assessment of the child's best interest must therefore be individual and based on the specific circumstances of the case.

The first part of this paper gives a basic legal understanding of the relevant departments of this subject. That includes the legal regulation as well as supplements from the sources of law concerning custody, contact, preventing contact, the child’s best interest and the principle of continuity. The swedish supreme court as well as the government bill of the Children and Parents Code declare that the custody of the child should, if no circumstances speaks against it, be entrusted in the parent that is most likely to support the contact between the child and the other parent. Typical circumstances that speak against such a ruling is the child’s opinion, protecting the child from harm, or the principle of continuity, which all are important parts of the assessment of the child’s best interest.

The second part of the paper consist of a detailed report of six custody trials from 2019 preceded by one parent preventing the other from contact with the child. The judgments are thereafter examined and compared to what the sources of law declare about the adjudication of the child’s best interest. The judgments show no correlation of outcome in relation to the extent of the prevention of contact. However, a pattern of which elements the court usually find necessary for the assessment of the child’s interest was discovered. These elements are: the adequacy of each parent as guardian, the child’s opinion and the principle of continuity. (Less)
