- Reglerna kring husrannsakan har sett i stort sett likadana ut sen tidigt 1900-tal. Vissa menar att detta gör att regelverket är hopplöst utdaterat och inte klarar av att möta nya problem som utvecklingen för med sig. Från vissa politiska håll har uttryckts vilja om att utvidga möjligheterna att företa husrannsakan. Denna uppsats undersöker de konstitutionella förutsättningarna för att införa regellättnader avseende reell husrannsakan i bostäder i kriminella miljöer.
Regeringsformen och Europakonventionen lägger vikt vid principerna om legalitet, proportionalitet, ändamål och behov. Förändringar av reglerna kring husrannsakan måste vara förenliga med samtliga dessa. En analys av Europadomstolens tillämpningar av konventionen ger vid handen... En analys av Europadomstolens tillämpningar av konventionen ger vid handen att en husrannsakan måste balansera husrannsakans nytta och skada. Bland annat läggs vikt vid faktorer som skälig misstanke och vilken typ av lokal som husrannsakan vidtas i. Hemmet åtnjuter ett särskilt skydd.
Uppsatsens analys landar i att en utvidgning kan vara konstitutionellt möjlig. Det krävs då bland annat att den begränsas till att avse vapen eller andra farliga föremål, och att särskild anledning finns att anta att dessa föremål finns i bostaden. (Less) - Abstract
- The legislation surrounding searches of locations have remained roughly the
same since the early 20th century. Some say this makes the code desperately
outdated and unable to face new problems arising. Some political actors
have expressed a wish to extend the possibilities of conducting searches.
This article examines the constitutional conditions, in view of the protected
right to privacy, for lessening the conditions in regard to searches of homes
connected to criminal associations. A formal dogmatic method is used.
The Instrument of Government and the European Convention emphasize the
principles of legality, proportionality, purpose and necessity. Legal reforms
of the rules surrounding searches must be compatible with all of... (More) - The legislation surrounding searches of locations have remained roughly the

outdated and unable to face new problems arising. Some political actors
have expressed a wish to extend the possibilities of conducting searches.
This article examines the constitutional conditions, in view of the protected
right to privacy, for lessening the conditions in regard to searches of homes
connected to criminal associations. A formal dogmatic method is used.
The Instrument of Government and the European Convention emphasize the
principles of legality, proportionality, purpose and necessity. Legal reforms
of the rules surrounding searches must be compatible with all of these. By
analysing the European Court, one finds that a search must strike a balance
between the advantages and disadvantages. Factors such as reasonable
suspicion and the nature of the premises, among other things, are
emphasized. The home, especially, is a protected premise.
The article reaches the conclusion that an extension may be constitutionally
viable. If that is to be so, the reform must limit itself to weapons and other
dangerous objects, and there must exist legitimate reasons for assuming that
they are located in the home in question. (Less)
