- Abstract
- The paper deals with the application of foreign law in Swedish court on a principled level. The rule of law is discussed on the basis of how well general legal principles have an impact in the application of the law.
The paper investigates the fundamental principles of general role in the application of law. The general principles that are treated more deeply in relation to the application of foreign law are jura novit curia, the principle of equality and the principle of loyalty.
The conditions concerning the application of foreign law and the examination of the content of foreign law are dealt with in general. The paper discusses the requirements that should be placed on the examination of the content of foreign law, who should be... The conditions concerning the application of foreign law and the examination of the content of foreign law are dealt with in general. The paper discusses the requirements that should be placed on the examination of the content of foreign law, who should be responsible for the loyalty of foreign law and the influence of Sweden’s membership in EU.
The conclusion shows that the conditions for the impact of principles can be improved. The principle of jura novit curia should be interpreted as the court having a responsibility that foreign law becomes sufficiently investigated and applied loyally. The difference between Swedish and foreign law in 35:2 RB should be eliminated. The principle of loyalty should apply in relation to the examination of the content of foreign law. - I uppsatsen behandlas tillämpningen av främmande rätt i svensk domstol på ett principiellt plan. Rättssäkerheten diskuteras utifrån hur väl allmänna rättsprinciper får genomslag i rättstillämpningen.
Uppsatsen utreder vad grundläggande principer har för allmän roll i rättstillämpningen. De allmänna principer som behandlas djupare i arbetet i förhållande till tillämpning av främmande rätt är jura novit curia, likställighetsprincipen och principen om lojal tillämpning.
Förutsättningarna kring tillämpning av främmande rätt och utredning av innehållet i främmande rätt behandlas översiktligt. Uppsatsen diskuterar vilka krav som bör ställas på utredningen av innehållet i främmande rätt, vem som bör bära ansvaret för att främmande rätt tillämpas lojalt samt vilket inflytande medlemskapet i EU har över rättstillämpningen.
Av slutsatsen framgår att förutsättningarna för principernas genomslag i praktiken kan förbättras. Principen om jura novit curia bör tolkas som att domstolen har ett ansvar för att främmande rätt blir tillräckligt utrett och tillämpas lojalt. Stadgandet som gör skillnad mellan svensk och främmande rätt i 35 kap. 2 § 2 men. RB kan förändras. Principen om lojal tillämpning bör gälla i förhållande till utredningen av innehållet i främmande rätt. Kraven på utredningen bör skärpas. (Less)
