Den sällsynta strejken - En studie om politisk strejk och dess rättsliga ramar

Under sommaren 2019 uppmanades de svenska fackliga organisationerna att utlysa en strejk för klimatet. Klimatstrejken skulle innebära en strejk i politiskt syfte, vilket därmed nekades av centralorganisationerna. Diskussionen om fackförbunden borde utlyst strejk samt om de då hade haft rättsligt stöd, gjorde frågan om politisk strejk högaktuell.

Denna uppsats utreder de rättsliga ramarna för politisk strejk, i syfte att försöka finna om, och i sådant fall när, en politisk strejk är tillåten. De slutsatser som går att dra utifrån denna undersökning, som är gjord enligt rättsdogmatisk metod, är att en politisk strejk måste framstå som en kortvarig protest- och demonstrationsåtgärd. Klimatstrejken skulle innebära en strejk i politiskt syfte, vilket därmed nekades av centralorganisationerna. Diskussionen om fackförbunden borde utlyst strejk samt om de då hade haft rättsligt stöd, gjorde frågan om politisk strejk högaktuell.

Denna uppsats utreder de rättsliga ramarna för politisk strejk, i syfte att försöka finna om, och i sådant fall när, en politisk strejk är tillåten. De slutsatser som går att dra utifrån denna undersökning, som är gjord enligt rättsdogmatisk metod, är att en politisk strejk måste framstå som en kortvarig protest- och demonstrationsåtgärd. Om strejken vidtas i uteslutande politiskt syfte, anses den falla utanför fredsplikten i MBL. Har den däremot både politiska samt fackliga inslag, faller den under MBL och tillåtligheten kan därmed ifrågasättas. Strejken behöver vara fackligt utlyst och påverkan på produktionen bör vara minimal. Den får inte heller gå i strid mot arbetsgivarens affärsledningsrätt, som ses regleras genom en dold klausul i kollektivavtal.

Det går dock inte, trots uppsatsens utredning, att med säkerhet säga i vilka situationer en politisk strejk kan beslutas vara lovlig. Vissa antaganden går att göra, men att Arbetsdomstolen skulle besluta i enlighet med dessa antaganden går inte att med säkerhet garantera. (Less)

During the summer of 2019 the Swedish trade unions were requested to announce a strike for the climate crisis. A strike for the climate would have meant a strike for political purposes, and therefore the trade unions abstained. The discussion on whether the trade unions should have announced a strike, and if they would have had the legal right to do so, made the question about political strike in Sweden current.

This thesis investigates the legal framework of the Swedish political strike, by the purpose to find out if and when a political strike is allowed. During the summer of 2019 the Swedish trade unions were requested to announce a strike for the climate crisis. A strike for the climate would have meant a strike for political purposes, and therefore the trade unions abstained. The discussion on whether the trade unions should have announced a strike, and if they would have had the legal right to do so, made the question about political strike in Sweden current.

This thesis investigates the legal framework of the Swedish political strike, by the purpose to find out if and when a political strike is allowed. The conclusions that can be drawn are that a political strike must be held within a short time frame and it must be an action of protest. If the strike is organised for purely political reasons, it falls outside the legal peace obligation on the Swedish labour market. However, if the strike has both political purpose and the purpose of a regular trade-union strike, the permissibility can be questioned. Prior to the strike the trade union is obliged to give notice to the employer. The affect on the production should be minimal. Nor can it go against the employer’s right to manage it’s business, which is regulated in Swedish collective agreements between employers and employees.

Despite the conclusions drawn in this thesis, it is not certain to say in what situations a political strike would possibly be allowed. Some assumptions can be made, but if the Swedish Labour Court actually would decide in accordance with these assumptions, cannot be said with certainty. (Less)
