- The focus of this essay is to describe and analyze case-law regarding termination of employment due to insufficiency in job performance. In order to present a comprehensive description of the present legal position, an overview of the Swedish Employment Protection Act (LAS) will be given. The term ‘saklig grund’ (objective ground) can be viewed as a linchpin of the right to terminate an employment. Therefore, the meaning and use of the term will be explained in order to provide the reader with an important basic understanding of termination due to personal reasons.

In order to present a comprehensive description of the present legal position, an overview of the Swedish Employment Protection Act (LAS) will be given. A distinction is made between the employer’s and the employee's responsibilities regarding an insufficient job performance. A description will also be made regarding circumstances applicable to the employment itself. The mapping of the case-law is followed by a summary and a comparison to a proposal of a new employment protection act that was published in the early nineties.
The analyzing chapter summarizes and comments on the information that have been collected on the subject. It appears that case-law in this matter presents a slightly employer hostile image. The employer is forced to carry out a very broad repertoire of interventions before an employee that is performing insufficiently can be terminated from employment. (Less) - Abstract (Swedish)
- Uppsatsens fokus är att beskriva och analysera rättspraxis gällande uppsägning på grund av bristande arbetsprestation. För att ge en god bild av rättsläget ges en översikt av lagen om anställningsskydd (LAS). Vidare ges en bakgrund och förklaring av begreppet ‘saklig grund’ som kan ses som en grundbult i uppsägningsrätten. Här redogörs för de rekvisit för saklig grund som arbetats fram i praxis.
