Barnets röst i frågor om vårdnad, boende och umgänge - Kommer den höras tydligare efter inkorporeringen av barnkonventionen?

Abstract (Swedish)
Uppsatsen syftar till att redogöra för och analysera barns delaktighet i tvister om vårdnad, boende och umgänge. Barn ges rätt till inflytande genom bestämmelser i såväl svensk rätt som genom internationella instrument. FN:s konvention om barnets rättigheter (barnkonventionen) ges en central roll i uppsatsen. Artikel 12 i barnkonventionen stadgar att barn ska tillförsäkras rätten att fritt uttrycka åsikter i alla frågor som rör barnet och att barnets åsikter ska tillmätas betydelse i förhållande till ålder och mognad.

Sverige ratificerade barnkonventionen 1990 och har sedan dess haft en
folkrättslig förpliktelse att följa bestämmelserna däri. Den svenska

Sverige ratificerade barnkonventionen 1990 och har sedan dess haft en
folkrättslig förpliktelse att följa bestämmelserna däri. Den svenska
lagstiftningen har därför reformerats i syfte att tillse att det råder
samstämmighet med de krav som kommer till uttryck i konventionen.
Principen i artikel 12 finns uttryckt i föräldrabalken (FB). I 6 kap. 2 a § FB stadgas att hänsyn ska tas till barnets vilja med beaktande av barnets ålder och mognad vid alla beslut om vårdnad, boende och umgänge. Trots det anses inte principen i artikel 12 ha fått önskat genomslag i den svenska rättstillämpningen. Den 1 januari 2020 gavs konventionen status av svensk lag genom att lag (2018:1197) om Förenta nationernas konvention om barnets rättigheter (barnrättslagen) trädde ikraft. Barnrättslagens ikraftträdande bedöms medföra ett förtydligade av att rättstillämpare ska beakta de rättigheter som följer av konventionen.

Uppsatsen utreder vilka följder barnrättslagen kan tänkas få för barns rätt att höras. Utredningen leder till ett konstaterande av att lagens inverkan på barns rätt till delaktighet beror av vad lagen kan komma att innebära för domstolens arbete. Sammanfattningsvis markerar inkorporeringen att konventionens artiklar samverkar vilket innebär att domstolen svårligen kan särskilja barns rätt till delaktighet i en domstolsprocess från rätten till delaktighet i vardagslivet. Rättigheterna i konventionen möter barnet där han eller hon befinner sig i livet vilket resulterar i en slutsats om att barns rätt till delaktighet i en domstolsprocess, inom socialtjänsten och i vardagslivet kommer närmare varandra. Domstolens arbete bedöms vara utslagsgivande för barns rätt till delaktighet men störst effekt torde fås utanför domstolsprocessen samt inom en sådan process till den del det inte avser en slutlig prövning i målet. This thesis is aiming to explain and analyse children’s participation in legal proceedings concerning custody, residence and visitation. Children are given the right to participation through regulations in Swedish law as well as in international legal instruments. The UN Convention on the Rights of the Child (the CRC) is given a central role in this thesis. Article 12 in the CRC statutes that children shall be assured the right to freely express their views in all matters affecting the child and that those views shall be given due weight in accordance with the age and maturity of the child.

The Swedish legislation has therefore reformed in order to ensure consistency with the requirements that are expressed in the Convention. The principle in Article 12 can be found in the Parental Code. Chap. 6 Sect. 2 a in the Parental Code statutes that the child’s will shall be taken into consideration in accordance with the age and maturity of the child in all decisions regarding custody, residence and visitation. Even so the principle in Article 12 is not considered having sufficient impact on decision-making processes in Sweden. On the 1st of January 2020 The United Nations Convention on the Rights of the Child Act (2018:1197) entered into force giving the CRC status of Swedish law which is expected to entail a clearer bond on legal practitioners to consider the rights that follow from the CRC.

This thesis investigates how children’s rights to participation may be
affected due to the incorporation of the CRC. It is noted that the impact on children’s rights to participation depends on what the incorporation may induce on the application of the law in Swedish courts. In summary, the incorporation indicates that the provisions of the Convention should interact meaning that the court hardly can distinguish the child’s right to participation in legal proceedings from the right to participation in everyday life. The rights in the CRC addresses the child wherever he or she is in Life resulting in a conclusion that the right to participation in legal proceedings,
within the social services and in everyday life are more intertwined.
Activities in court are considered being the decisive element for child
participation but the greatest effects are likely to be obtained in everyday life and within legal proceedings to the extent it does not refer to a final judgement. (Less)
