Principen om barnets bästa mot bakgrund av hovrättsmål T 11396-17

I hovrättsmål T 11396-17 fick en pappa, som tidigare dömts för att ha misshandlat sina barn, ensam vårdnad om barnen eftersom mamman ansågs ha gjort sig skyldig till umgängessabotage. I denna uppsats har jag närmare studerat principen om barnets bästa enligt 6 kap 2a § föräldrabalken, mot bakgrund av hovrättsmål T 11396-17. I svensk rätt grundar sig varje beslut om vårdnad, boende och umgänge på barnets bästa, enligt 6 kap 2a § 1 st. föräldrabalken. Avgörandet av vad som är barnets bästa grundar sig på en prognos om vad som i framtiden kan antas vara till barnets bästa. I 6 kap 2a § 2 st. föräldrabalken framgår att det är i

I hovrättsmål T 11396-17 fick en pappa, som tidigare dömts för att ha misshandlat sina barn, ensam vårdnad om barnen eftersom mamman ansågs ha gjort sig skyldig till umgängessabotage. I denna uppsats har jag närmare studerat principen om barnets bästa enligt 6 kap 2a § föräldrabalken, mot bakgrund av hovrättsmål T 11396-17. I svensk rätt grundar sig varje beslut om vårdnad, boende och umgänge på barnets bästa, enligt 6 kap 2a § 1 st. föräldrabalken. Avgörandet av vad som är barnets bästa grundar sig på en prognos om vad som i framtiden kan antas vara till barnets bästa. I 6 kap 2a § 2 st. föräldrabalken framgår att det är i
enlighet med barnets bästa att barnet har en nära och god kontakt med båda sina föräldrar. Detta ska dock inte ske på bekostnad av risken att barnet ”utsätts för övergrepp… eller annars far illa.” I hovrättsmål T 11396-17 ansågs risken för att barnen i framtiden skulle utsättas för våld av sin pappa liten. När risken för våld anses vara liten och denna risk ställs mot risken för ett umgängessabotage, antas det sistnämnda vara mer skadligt för barnet. Umgängesrätten i svensk barnrätt
måste sammantaget anses väga tungt. I hovrättsmål T 11396-17 ansågs mammans umgängessabotage väga tyngre än både barnens behov av kontinuitet och stabilitet och risken för att barnen skulle utsättas för våld av pappan. (Less)

In court case T 11396-17, a father who was previously convicted of abusing his children was entrusted with sole custody, because the mother was considered guilty of sabotaging the contact between the children and the father. In this essay I have studied the principle of best interests of the child in the light of court case T 11396-17. In Swedish law, every decision on custody, residence and contact is based on what is the best interests of the child, according to section 2a in the 6th chapter of the Children and Parents Code. In court case T 11396-17, a father who was previously convicted of abusing his children was entrusted with sole custody, because the mother was considered guilty of sabotaging the contact between the children and the father. In this essay I have studied the principle of best interests of the child in the light of court case T 11396-17. In Swedish law, every decision on custody, residence and contact is based on what is the best interests of the child, according to section 2a in the 6th chapter of the Children and Parents Code. The decision on what is best for the
child is based on a forecast of what is assumed to be in the best interest of the child in the future. When the court makes its assessment, it has to make sure that the child’s need of good contact with both parents is satisfied. However, the child’s need of good contact with both parents should not be satisfied if there is a risk that
the child will be subjected to abuse… “or otherwise suffer significant harm”. In court case T 11396-17 the risk of future violence was considered to be small. When the risk of future violence is small and is compared to the risk of not being in good contact with both parents, the latter is assumed to be more harmful to the child. In summary, the child’s right to have a personal relationship and direct contact with
both parents weighs heavily in Swedish law. In court case T 11396-17 the mother’s contact sabotage was considered to outweigh both the children's need for continuity and stability, and the risk that the children may be subjected to the father’s abuse in the future. (Less)
