Innebörden av konkurrens - En hermeneutisk studie av konkurrensbegreppets konstituerande betingelser

Abstract
The word competition is often regarded as being ambiguous. Despite the word’s ambiguity the field of competition law undertakes to protect competition. In the legal literature the definition of the meaning of the word is seldom discussed. When it is being defined, the definitions appear to be inadequate regarding the words meaning in everyday speech. How it is then possible to have a coherent area of law and protect competition without providing an adequate answer to the most basic question, what is the meaning of competition and what are the necessary conditions that constitute competition?

The word competition is often regarded as being ambiguous. Despite the word’s ambiguity the field of competition law undertakes to protect competition. In the legal literature the definition of the meaning of the word is seldom discussed. When it is being defined, the definitions appear to be inadequate regarding the words meaning in everyday speech. How it is then possible to have a coherent area of law and protect competition without providing an adequate answer to the most basic question, what is the meaning of competition and what are the necessary conditions that constitute competition?

To find an answer to the questions being raised this essay employs the hermeneutical method. The method tries to reach comprehension about the studied topic by interpreting the studied topic as something. The interpretation to reach comprehensions builds upon that comprehension is reached by the interaction between the holistic understanding of what’s being studied and of the parts that constitute the whole. To reach a holistic understanding the parts must be understood in relation to the holistic understand and vice versa.

To reach an understanding of the meaning of competition the word will be analyzed and critically interpreted partly concerning its etymological meanings, partly in relation to definitions given in dictionaries, encyclopedias as well as in the legal literature. A critical analysis will be performed following the presentation of meanings and definitions regarding if the explicit and implicit parts of the given meaning or definitions can be considered as constituting parts to the holistic understanding of the words meaning in everyday speech.

The result attained by the interpretation and analysis concludes that four conditions are regarded as necessary to constitute competition. The constituting conditions are partly that there must be a presence of more than one participant, partly that the participants must act, partly that the act is done in order to realize a goal which is in shortage, partly that the outcome of the distribution of the shortage is unknown beforehand.

Based on the constituting parts a conclusion is reached that competition can be understood as a process that emerges when two or more parties tries to acquire or achieve anything which is in shortage if it beforehand is unknown whether or not the parties will be successful or how the shortage will be distributed between the parties. Termen konkurrens uppfattas ofta som mångtydig. Trots dess ansedda mångtydighet företar konkurrensrätten som rättsområde att skydda konkurrensen. Sällan förekommer diskussioner i den juridiska litteraturen gällande betydelsen av konkurrens. De definitioner som har angetts förefaller undermåliga i relation to ordets allmänna innebörd. Hur kan vi då ha sammanhållet rättsområde samt skydda konkurrens utan att först ha besvarat den mest fundamentala frågan, vad är innebörden av konkurrens och vilka är de nödvändiga konstituerande betingelserna som utgör termens innebörd?

Tolkningen sker utifrån att förståelse bygger dels på en helhetsförståelse, dels en förståelse av delarna varemellan det råder ett samspel. För att förstå helheten måste delarna förstås i relation till helheten och vice versa.

För att bygga upp en förståelse av konkurrens analyseras och kritiskt tolkas dels termens etymologiska betydelser, dels förekommande definitioner i ordböcker, uppslagsverk samt inom den juridiska litteraturen. Löpande sker en kritisk analys av hur definitionernas explicita och implicita delar förhåller sig till helhetsförståelsen av en allmän definition av konkurrens.

Tolkning och analys av definitionerna resulterar i att fyra betingelser anses vara nödvändiga för att konstituera konkurrens. De konstituerande betingelserna är att det dels måste förekomma flera aktörer, dels att aktörer måste företa en handling, dels att handlingen syftar till att realisera ett mål varom det råder brist, dels att utfallet av fördelningen av bristen är okänt på förhand.

Utifrån de konstituerande delarna dras slutsatsen att konkurrens kan förstås som en process som uppstår när två eller fler parter försöker erhålla eller uppnå något som det råder brist om när det är okänt på förhand huruvida bristen kommer att realiseras eller distribueras mellan parterna. (Less)
