Abstract (Swedish)
Barnets bästa ska vara avgörande när det fattas beslut som gäller vårdnad, boende och umgänge. Denna bestämmelse finns i föräldrabalkens 6.2a §. Paragrafen poängterar även att hänsyn ska tas till barnets behov av en nära och god kontakt med båda föräldrarna samt till barnets egna vilja.
Syftet med uppsatsen är att undersöka vad den gällande rätten kring barnets bästa i vårdnadstvister är, samt att se på hur domstolarna resonerar kring principen i rättssalen. Vårdnadsmål från Malmö tingsrätt undersöks för att få en djupare insyn i domstolens syn på barnets bästa.

Uppsatsen utreder vissa centrala begrepp som gemensam och ensam vårdnad, föräldrars överenskommelser och samarbetssvårigheter samt barnets vilja. Utredningen sker med hjälp av doktrin, och detta jämförs sedan med vad som sker i domstolen.
I slutet av uppsatsen granskas det hur mycket vikt domstolarna faktiskt lägger på principen om barnets bästa när de avgör vårdnadstvister. (Less)
Abstract
The best interest of the child is a crucial factor ​when making decisions regarding custody, residence and visitation. This regulation can be found in section 6.2 a § of the Swedish Parental code. The paragraph also points out the child's need for close contact with both parents and the child's own will, which must be taken into account before making certain decisions regarding custody.
The purpose of the thesis is to investigate what the established law says regarding the child's best interest in custody disputes. The investigation is done with the help of legal literature and customs. The thesis explores central concepts such as joint and sole custody, agreements and cooperation difficulties as well as the child's will.
