Beskickningslokalers okränkbarhet och rätten till liv - En kritisk studie av konflikten mellan två inom den internationella rätten fundamentala principer

Abstract
The role of diplomatic immunity within international law is one of great importance. The principle of inviolability of mission premises is governed by Article 22 of the Vienna Convention on Diplomatic Relations and is in its wording absolute. The provision states that a recipient state is prohibited from entering the premises without the consent of the head of the mission. At the same time, the receiving state has a positive obligation to protect the mission premises against intrusion and to prevent violations of the mission.

The role of diplomatic immunity within international law is one of great importance. The principle of inviolability of mission premises is governed by Article 22 of the Vienna Convention on Diplomatic Relations and is in its wording absolute. The provision states that a recipient state is prohibited from entering the premises without the consent of the head of the mission. At the same time, the receiving state has a positive obligation to protect the mission premises against intrusion and to prevent violations of the mission.

The right to life is another highly important principle, also interpreted as inviolable. A question therefore arises regarding how such a situation, when two fundamental principles are opposed of each other, should be resolved. The thesis intends to from a critical perspective investigate the scope of the inviolability of the mission premises in international law and to problematize this in regard to situations when the inviolability gets in conflict with the basic human right to life.

Practical examples show that states have maintained the inviolability of mission premises even in situations where human lives have been in direct danger. The work will demonstrate that there is scope to argue the position that the human right to life can be an exception to the provision on inviolability. It is also concluded that no definitive answer can be given regarding the question of which principle should rank higher as there is a lack of norm hierarchy in international law. It is also demonstrated that the principle of reciprocity in the Vienna Convention may very well be the reason as to why the inviolability of the mission premises is maintained in the manner that is done. Den diplomatiska immuniteten har spelat en viktig roll inom den internationella rätten och det diplomatiska arbetet i världen under en mycket lång tid. Principen om beskickningslokalers okränkbarhet regleras i artikel 22 i Wienkonventionen om diplomatiska förbindelser och är enligt sin ordalydelse absolut. Bestämmelsen innebär att mottagarstaten är förbjuden att beträda lokalen utan beskickningschefens medgivande, samtidigt som det finns en positiv skyldighet för mottagarstaten att skydda beskickningslokalen mot intrång och att förhindra att beskickningens kränks.

Arbetet ämnar att ur ett kritiskt perspektiv undersöka räckvidden av beskickningslokalers okränkbarhet i den internationella rätten och problematisera situationer då denna ställs emot den grundläggande mänskliga rätten till liv.

Praktiska exempel visar att stater har upprätthållit beskickningslokalers okränkbarhet även i situationer då människors liv har varit i direkt fara. Arbetet kommer påvisa att det finns utrymme att argumentera för ståndpunkten att människors rätt till liv trots allt kan utgöra ett undantag till bestämmelsen om okränkbarhet. Samtidigt dras slutsatsen att något definitivt svar gällande vilken princip som bör högre rang på grund av avsaknaden av normhierarki i den internationella rätten. Det påvisas också att principen om reciprocitet i Wienkonventionen mycket väl kan vara anledningen till att varför beskickningslokalers okränkbarhet upprätthålls på det viset som görs. (Less)
