Covid-19 har med den snabba spridningstakten och höga dödstalen fått stor medial uppmärksamhet i hela världen. Runt omkring i världen har åtgärd efter åtgärd vidtagits i ett försök att minska smittspridningen. Den här uppsatsen syftar till att redogöra för och jämföra hur de skandinaviska länderna har begränsat mötesfriheten med anledning av Covid-19.

De skandinaviska länderna har mycket gemensamt vad avser historia, kultur och språk. Den nära kopplingen har bland annat gett upphov till gemensam lagstiftning på flera områden. Då grundlagarna är produkter från händelserna vid deras tillkomst regleras mötesfriheten något olika, gemensamt är att de kan begränsas med anledning av en pandemi. Covid-19 har med den snabba spridningstakten och höga dödstalen fått stor medial uppmärksamhet i hela världen. Runt omkring i världen har åtgärd efter åtgärd vidtagits i ett försök att minska smittspridningen. Den här uppsatsen syftar till att redogöra för och jämföra hur de skandinaviska länderna har begränsat mötesfriheten med anledning av Covid-19.

De skandinaviska länderna har mycket gemensamt vad avser historia, kultur och språk. Den nära kopplingen har bland annat gett upphov till gemensam lagstiftning på flera områden. Då grundlagarna är produkter från händelserna vid deras tillkomst regleras mötesfriheten något olika, gemensamt är att de kan begränsas med anledning av en pandemi. Hur begränsningen sker i lag och förordning skiljer sig något mellan länderna. Bestämmelser för hur mötesfriheten begränsas i länderna redogörs för separat för att sedan jämföras i analysen där frågeställningarna besvaras.

Analysen visade att mötesfriheten i grundlagarna kan begränsas med anledning av en pandemi, antingen genom en hänvisning till en uttrycklig bestämmelse eller genom tolkning av praxis. Närmare bestämmelser om begränsning med anledning av en pandemi fanns antingen på smittskyddsområdet eller genom bestämmelser i ordningslag. En likhet mellan länderna är att Covid-19 har varit tvungen att tas upp i listan över allmänfarliga sjukdomar för att möjliggöra begränsningar av mötesfriheten. Begräsningarna har varit förenade med en möjlighet att delegera begränsningsmakten till andra myndigheter än riksdagen. (Less)

Covid-19 has, with its rapid spread and high mortality rate, received great media attention throughout the world. Across the world, measure after measure has been brought in effect in an effort to reduce the spread of the virus. The purpose of this thesis is to describe and compare how the Scandinavian countries have restricted freedom of assembly due to Covid-19.

The Scandinavian countries have a lot in common in terms of history, culture and language. Their close connection has, among other things, given rise to common legislation in several areas. Across the world, measure after measure has been brought in effect in an effort to reduce the spread of the virus. The purpose of this thesis is to describe and compare how the Scandinavian countries have restricted freedom of assembly due to Covid-19.

The Scandinavian countries have a lot in common in terms of history, culture and language. Their close connection has, among other things, given rise to common legislation in several areas. Since the constitutions are products of the time upon their creation, freedom of assembly is regulated somewhat differently, commonly is that freedom of assembly can be restricted, due to a pandemic. How the restriction is made by law and regulation differs somewhat between the countries. Regulation on how freedom of assembly is restricted in the countries are presented separately and then compared in the analysis where the questions are answered.

The analysis showed that freedom of assembly in the constitutions can be limited due to a pandemic, either by reference to an explicit provision, or by interpretation of practice. Further regulations on limitation due to a pandemic were either found in the area of protection against infection, or through provisions in the law of order. A similarity between the countries is that Covid-19 has had to be included in the list of dangerous diseases in order to enable the restrictions on freedom of assembly. The restrictions have been linked to an ability to delegate the authority to limit the freedom to authorities other than the parliament. (Less)
