Abstract
This master thesis evaluates the outcome of the Law (2014:899) on guidelines for municipal land use that were adopted in 2015. According to this, all the municipalities who work with the land allocation processes, must adopt guidelines for this process. The law does not regulate in detail and it is therefore open for interpretations. The reason to adopt the law was to increase transparency, predictability and competition among developers, but also to be a good support for the municipalities. The law was passed as a consequence of the massive criticism that had been made towards the system of land allocation. The work was initiated with a theoretical study and then an empirical study was conducted in three parts. In the first step, guidelines from 189 municipalities were studied to see what each of the guidelines regulates. In the second step, agreements for land allocation were requested from twelve municipalities to see whether the regulations in the agreement corresponded with the guidelines. In the third step, the regulation for social sustainability in the guidelines and the agreement for land allocation were compared with the contract of sale. The study also aims to identify the risks that a land allocation entails for a developer.

Most municipalities do not give any compensation if the project is terminated and the developer is expected to invest large resources on projection, geological surveys and the development of zoning plan for instance. This causes the developer to take a great risk when working with land allocation.

Regarding the social commitments, the study shows that tenure is the most common commitment in the contracts. Another common demand is that the municipality wants to rent apartments for their social work.

The conclusion from the study is that most of the guidelines are general and this results in lack of transparency and predictability for the developer. General guidelines make it easy for the municipality to follow them and most of the guidelines are also followed in the agreements, but there is an increased risk that the agreements vary a lot from case to case. Riktlinjerna utgör inte ett bindande dokument utan ses som vägledande för markanvisningsprocessen. I detta examensarbete undersöks utfallet av lagen samt om syftet med lagen uppfylls.

Studien initierades med en teoretisk genomgång för att förstå det juridiska regelverk som styr markanvisningsprocessen. Därefter genomfördes en empirisk studie i tre delar. I steg ett undersöktes hur många av Sveriges 290 kommuner som antagit riktlinjer för markanvisningar (189 st) och vad respektive kommun reglerar. Steg två av studien innebar att markanvisningsavtal från tolv kommuner begärdes ut (totalt 132 st) och det undersöktes vad avtalen reglerar samt om dessa stämmer överens med respektive kommuns regleringar i riktlinjerna. Av de markanvisningar som övergått till överlåtelse genomfördes i steg tre av den empiriska studien stickprov för att se om samma krav även ställs i överlåtelseavtalet. Resultatet av steg tre visar att krav på framtida upplåtelseform är det vanligaste förekommande. Krav på att byggherren ska upplåta en del bostäder till kommunen som kan hyras ut i andra hand för bostadssocial verksamhet förekommer också i stor omfattning och i majoriteten av fallen överensstämmer kraven som anges i riktlinjerna med de krav som finns i de senare avtalen.

År 2015 gjordes en undersökning där Sveriges 50 största kommuners riktlinjer undersöktes. Vid det tillfället hade 75 % av dessa kommuner antagit riktlinjer. Motsvarande siffra är idag 88 %, vilket visar att lagen medfört att fler kommuner har antagit riktlinjer.

I detta examensarbete har stor fokus lagts på den risk som en markanvisning medför för en byggherre. Det råder stor konkurrens om att få mark tilldelad, vilket medför att kommunen kan lägga risk och ansvar på byggherren utan att denne backar från fullgörande av kontraktet. I undersökningen framgår det att tre av fyra kommuner inte ger någon form av kompensation till byggherren om markanvisningen avbryts. Detta i kombination med att byggherren förväntas lägga ner stora resurser på exempelvis projektering, geologiska undersökningar och detaljplaner, resulterar i att risken med markanvisningar blir stor för byggherren.

Slutsatsen som dras av studien är att riktlinjerna är generellt utformade vilket medför att kommunerna enkelt kan följa riktlinjerna som i sin tur gör att avtalen till stor del stämmer överens med vad riktlinjerna reglerar. Avsaknaden av utförliga regleringar riskerar att villkoren i markanvisningsavtalen inom en kommun skiljer sig ut. Nästan fyra av fem kommuner anger i sina riktlinjer att de får frångå de regleringar som anges. Detta i kombination med att riktlinjerna är generella i sin utformning medför att transparensen och förutsebarheten inte är god gentemot byggherrarna och lagen uppnår i dagens läge inte sitt syfte.
