Misskötsamhet på grund av alkohol - En komparativ studie mellan Sverige och Danmark

Denna komparativa uppsats analyserar vilka likheter och skillnader det finns mellan Sverige och Danmark avseende uppsägning och avsked vid misskötsamhet på grund av alkohol. Vidare analyseras vilken vikt som fästs vid arbetsgivarens intresse vid intresseavvägningen. För att besvara frågeställningarna har rättsdogmatiskt- och komparativ metod använts. Det föreligger både skillnader och likheter mellan länderna. En viktig skillnad mellan länderna är hur anställningsskyddet ser ut och vem som omfattas av detta. Vidare synes det vara enklare för arbetsgivaren att säga upp eller avskeda en arbetstagare som missköter sig på grund av alkohol i Danmark jämfört med Sverige. Denna komparativa uppsats analyserar vilka likheter och skillnader det finns mellan Sverige och Danmark avseende uppsägning och avsked vid misskötsamhet på grund av alkohol. Vidare analyseras vilken vikt som fästs vid arbetsgivarens intresse vid intresseavvägningen. För att besvara frågeställningarna har rättsdogmatiskt- och komparativ metod använts. Det föreligger både skillnader och likheter mellan länderna. En viktig skillnad mellan länderna är hur anställningsskyddet ser ut och vem som omfattas av detta. Vidare synes det vara enklare för arbetsgivaren att säga upp eller avskeda en arbetstagare som missköter sig på grund av alkohol i Danmark jämfört med Sverige. Arbetsgivarens avsked och uppsägningsrätt mer långtgående i Danmark då alkoholproblem oftare motiverar en uppsägning eller avsked. I Sverige är rättstillämpningen mer förmånlig för arbetstagarna då det ställs ett förhållandevis högt krav på arbetsgivaren vid misskötsamhet på grund av alkohol och ett ännu mer omfattande krav vid alkoholmissbruk av sjukdomskaraktär. Alkoholpolitiken skiljer sig även mellan länderna. Där alkoholpolitiken i Sverige har fått ett stort genomslag i Arbetsdomstolens bedömning på bekostnad av arbetsgivarens intresse. I Danmark handlar domstolarnas argumentation mer om arbetstagarnas skyldigheter. Ur en arbetsgivarsynvinkel kan det antas att dennes intresse bättre tillgodoses i Danmark då danska arbetsgivares skyldigheter inte är lika långtgående. (Less)
Abstract
This comparative essay analyses the similarities and differences between Sweden and Denmark in terms of termination and dismissal in the case of alcohol caused malpractice. Furthermore, this essay analyses how much emphasis that is put on the employer’s interest in the courts balancing of interests. In order to answer the questions traditional legal dogmatic method and comparative method has been used. There are differences and similarities between the countries. An important difference between the countries is how employment protection is formed and who is covered by it. Furthermore, it seems easier for the employer to terminate or dismiss a worker who malpractice their work due to alcohol consumption in Denmark compared to Sweden.... (More)
This comparative essay analyses the similarities and differences between Sweden and Denmark in terms of termination and dismissal in the case of alcohol caused malpractice. Furthermore, this essay analyses how much emphasis that is put on the employer’s interest in the courts balancing of interests. In order to answer the questions traditional legal dogmatic method and comparative method has been used. There are differences and similarities between the countries. An important difference between the countries is how employment protection is formed and who is covered by it. Furthermore, it seems easier for the employer to terminate or dismiss a worker who malpractice their work due to alcohol consumption in Denmark compared to Sweden. Employer's ability to terminate or dismiss an employee go further in Denmark, since alcohol problems more often motivate a termination and dismissal. In Sweden, the legal application is more favourable to the employees, as there are fairly high demands on the employer in the case of malpractice due to alcohol consumption, and even further demands in the case of alcoholism. Alcohol policies also differs between the countries, alcohol policies in Sweden has had a major impact in the Labour Court's judgment at the expense of the employer's interests. In Denmark, the courts are more concerned about workers' obligations. From an employer's point of view, it can be assumed that its interests are better met in Denmark, since Danish employers' obligations are not as far-reaching. (Less)
